I <br /> <br />I <br />I <br />I <br /> <br />I <br />I <br /> I <br /> <br />and <br /> <br />westerly a distance of 879.65 feet along a tangential curve concave to the <br />south having a radius of 560.00 feet and a central angle of 90 degrees 00 <br />minutes 00 seconds; thence south 50 degrees 58 minutes 34 seconds west, <br />tangent to last said curve a distance of 40.02 feet to the northeasterly line of <br />the Burlington Northern Railroad and there terminating. <br /> <br /> WHEREAS, the basis tbr the request was that 153r'~ AvenUe or Alpine Drive <br />N.W. was subsequently constructed in a different location than that which was described <br />on Document #156666, conveyed to the City in 1986; and <br /> <br /> WHEREAS, the City Council conducted a public hearing on October 22, 2002 <br />regarding the request to vacate the Subject Easement; and <br /> <br /> WHEREAS, the City Council request, ed .additional informati°n regarding <br />whether the City paid for the easement and the usefulness of the easement for a possible <br />Highway 10 interchange; and <br /> <br /> WHEREAS, City Staffhas not found any information that indicates the City paid <br />for the easement; and <br /> <br /> WHEREAS, City Staff has reviewed the proposed easement vacation with <br />Mn/DOT staff and preliminarily determined that the easement could have merit if a Hwy. <br />10 interchange is aligned between Jarvis Street and AlPine Drive N.W.; and <br /> <br /> WHEREAS, Mn/DOT has requested the opportunity to review and comment on <br />the proposed vacation and their Comments may be ready early in 2003. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the request to vacate the Subject Easement is herein denied based on the <br />potential merits of its existence as it relates to the Inter-Regional Corridor Plan for <br />T.H. #10. <br /> <br />The motion for the <br />Councilmember <br />in favor thereof: <br /> <br />adoption of the foregoing resolution was duly seconded by <br /> ., and upon vote being taken thereon, the following voted <br /> <br />and the following voted against: <br />and the following abstained: <br />and the following were absent: <br /> <br />-141- <br /> <br /> <br />
