WHEREAS, the basis tbr the request was that 153r'~ AvenUe or Alpine Drive N.W. was subsequently constructed in a different location than that which was described on Document #156666, conveyed to the City in 1986; and WHEREAS, the City Council conducted a public hearing on October 22, 2002 regarding the request to vacate the Subject Easement; and WHEREAS, the City Council request, ed .additional informati°n regarding whether the City paid for the easement and the usefulness of the easement for a possible Highway 10 interchange; and WHEREAS, City Staffhas not found any information that indicates the City paid for the easement; and WHEREAS, City Staff has reviewed the proposed easement vacation with Mn/DOT staff and preliminarily determined that the easement could have merit if a Hwy. 10 interchange is aligned between Jarvis Street and AlPine Drive N.W.; and WHEREAS, Mn/DOT has requested the opportunity to review and comment on the proposed vacation and their Comments may be ready early in 2003. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the request to vacate the Subject Easement is herein denied based on the potential merits of its existence as it relates to the Inter-Regional Corridor Plan for T.H. #10.
