UNDUE HARDSHIP EXCEPTIONS The City Council may grant an exception to the provisions of this Ordinance when, in its opinion, undue hardship or a practical difficulty may result from strict compliance. In granting an exception, the City Council shall prescribe any conditions that it deems necessary to or desirable for the protection of the public interest. N exception shall be granted unless the City Council finds: 1. That there are special circumstances or conditions affecting said property such that the strict application of the provisions of this Moratorium Ordinance would deprive the petitioner of the reasonable use of petitioner's land. 2. That the exception is necessary for the preservation and enjoyment of a substantial property right of the petitioner. 3. That the granting of the exception will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated. 4. That the proposed exception will be harmonious with and in accordance with the specific objectives of the City's existing Comprehensive Plan and will not adversely affect the planning process for adoption of amendments to the Comprehensive Plan above described. 5. That the proposed use/subdivision will be consistent with the intent and purpose of this Ordinance. SECTION 5. TERM The term of this Ordinance shall be for a period of twelve (12) months commencing with its effe,ctive date. The term may be extended after approval by the City Council for an additional period not exceeding six (6) months, as provided for in Minnesota Statutes, Section 462.355, Subd. 4. I I I I I !
