The City agrees to contribute a not to exceed amount of $150,000.00 to the cost of <br /> constructing a 30" trunk sanitary sewer line from its existing location to the north <br /> fight-of-way of Alpine Dr. NW. <br /> b. Tb.e City agrees to allow the Developer to utilize all of the trunk fee money <br /> generated from this first phase of 44 lots as well as an additional 156 lots that will <br /> be platted in the future on land under the Developer's control within the "triangle" <br /> during a five year period following the date of final approval of Villas of Meadow <br /> Point. The "triangle" is defined by the right-of-ways of Alpine Dr. NW, County <br /> Road 5 (Nowthen Blvd.), and County Road 57 (Sunfish Lake Blvd.). <br /> c. The trunk fee money that the City is allowing the Developer to utilize is to be <br /> used to construct the 30" trunk sanitary sewer line through the site and across <br /> County Road 5 at a depth and alignment as approved by the City Engineer. <br /> d. If tb_e cost to construct the above mentioned 30" trunk sanitary sewer line through <br /> the site plus a 25% increase for design, contract administration, legal, and <br /> contingency is below that which will be generated from trunk fees,, then the <br /> difference will be due to the City from the Developer upon final platting of a <br /> subsequent phase. <br /> <br />19. <br /> <br />Citizen Petition: On October I 1, 2002, the City of Ramsey received notification from the <br />Minnesota Environmental Quality Board that a valid citizen petition requesting that the <br />City require an Environmental Assessment Worksheet (EAW) be completed for Villas of <br />Meadow Point. The petition raises three potential environmental effects that could occur <br />with the Villas of Meadow Point development; 1) Harm to the natural habitat of the <br />Blanding's Turtles, 2) Reduction of the habitat for other wildlife, 3) Decline of water <br />quality and supply. Under State law, the City Council cannot make any final government <br />approvals of a project until the need for an EAW has been determined. State statutes <br />allow for the City Council to take up to 30 working days to make a decision. You have <br />indicated that you will be bringing forward information addressing the citizen petition's <br />concerns at the October 22, 2002 City Council meeting. Under State !aw, the City has 30 <br />working days to make a determination on whether an EAW shall be conducted. That date <br />expires NOvember 22, 2002. <br /> <br />The City Council will be meeting at 7:00 p.m. on Tuesday, October 22, 2002, at Ramsey Fire <br />Station #2, to conduct a public hearing regarding the proposed preliminary plat. A copy of the <br />case cover sheet is enclosed for your information. I suggest that you, or your representative, be <br />present at the meeting to answer any questions that may arise.
