UNDUE HARDSHIP EXCEPTIONS <br /> <br />The City Council may grant an exception to the provisions of this Ordinance when, in its <br />opinion, undue hardship or a practical difficulty may result from strict compliance. In <br />granting an exception, the City Council shall prescribe any conditions that it deems <br />necessary to or desirable for the protection of the public interest. N exception shall be <br />granted unless the City Council finds: <br /> <br />1. That there are special circumstances or conditions affecting said property such <br />that the strict application of the provisions of this Moratorium Ordinance would deprive <br />the petitioner of the reasonable use of petitioner's land. <br /> <br />2. That the exception is necessary for the preservation and enjoyment of a <br />substantial property right of the petkioner. <br /> <br />3. That the granting of the exception will not be detrimental to the public welfare or <br />injurious to other property in the area in which the property 'is situated. <br /> <br />4. That the proposed exception will be harmonious with and in accordance with the <br />specific objectives of the City's existing Comprehensive Plan and Will not adversely <br />affect the planning process for adoption of amendments to the Comprehensive Plan above <br />described. <br /> <br />5. That the proposed use/subdivision will be consistent with the intent and purpose <br />of this Ordinance. <br /> <br />SECTION 5. TERM <br /> <br />The term of this Ordinance shall be for a period of twenty-four (24) months commencing <br />with its effective date. The term may be extended alter approval by the City Council for <br />an additional period not exceeding six (6) months, as provided for in Minnesota Statutes, <br />Section 462.355, Subd. 4. <br /> <br />SECTION 6. PENALTIES <br /> <br />Any person, firm, entity or corporation that undertakes any development activity in <br />violation of the provisions of this Ordinance shall be guilty of a misdemeanor and shall <br />be subject to any additional legal or equitable remedies available to the City. <br /> <br />-425- <br /> <br /> <br />
