three larger, rural lots on the west that are also zoned R-1 Residential, located within the MUSA
and eli~ble for redevelopment at urban standards. The new density transition ordinance does not
clearly state what the requirements would be, if any, in situations where the adjacent property is
in the MUSA, zoned the same as the developing parcel, but currently consists of the larger, rural
type lots.

John Peterson, Oakwood Land Development, stated that he has been working with the existing
four homeowners on the site and has entered into a purchase agreement with each of them. In
addition he has met with all of the property .owners to the west of the proposed development.
The first property is a rental property, the second parcel is five a res with a pretty
boundary, the third property owner has lived on the property for many years.
homeowners has seen the plan and they all understand the potential of their own pr~ ng
developed in the future. He did not want to speak ~br those homeowners,
understood the development potential. He noted that the only issue wi~!~ !:arg~r parcel
it was used to raise etk. and' so it contains a ten-foot tall fence along al ~tJfintiai distance o~.,
property,. One resident has asked that they extend that fen~_ii~!She"has told them that
could. Mr. Peterson stated that the natural screening that exl~::$n the prope~ turns out to
perfect. He presented pictures of the property and inventory of t5~ many;t~e~gi:i~h!at would serve
as a screen on each of the lots. He also sta[e4,,that he would ~!;:,ws~gi:fb;~place restrictive
covenants on the property so that none of the ~Uffe~g trees could'~ ~t~;bed.

Councilmember Kurak inquired as to how mar~y'6f the"~.ees:,pictures weg~ on his property.

Mr. Peterson replied'that a'li:~p:th~2~ees he inciiid~d ~:~b}ihVenf0W,preS'efifed to the Council are
on his land. 14e::~oted::'~at there a~g additional O~S¢~th'~ adjaddni~rceld.

Coungjlmember:~ehdriksen: ~uii:~d if the re :idCts were aware of the meeting since part of
Sion shod~be.B&~ ;b;,he.,~g,~om the~siaents.

Mr. Peters~}~plied'~ha~lae was nOt asking' f0r'~ decision from the 'C0uncii at tonight's meeting.
He was onlY~I'boking Gr.'a~ndnformal discussion. He noted that all of the residents are aware that

~:i'}~}!7~Councilmembe~'~endriksen inquired if staff notified any of the residents of th/s meeting.

~evelopment Director Frolik replied no, because there will be a'public hearing.

Mr~.~'Peterson stated that each of the property owners understand that brining sewer and water to-
their property will increase the value of their properties, but he does not want to put any words in
their mouths. He would like them to have the opportunity to speak at the public hearing.

Councilmember Hendriksen stated that he thinks residents should be heard on what they want
and be able to make an informed decision. The only part that concerns him is that if they are
only deriving the intbrmation from the developer theY might only have one side of the story.

-154-

City Council/October 15, 2002
