-128- <br /> <br />I am the President and CEO of a company directly south of the site. Our address <br />is 6180 140th Ave NW. Our building faces to the north. I also own the building in <br />a separate partnership. I am a business owner that has customers coming in on <br />a dally basis to visit our facility. <br /> <br />With the expansion of the facility across the street this brings up a number of <br />questions. When Marshall took over the facility from the past company (AMCON, <br />, they have expanded their storage space to the east of the building with sand <br />and gravel on a cement slab with cinder block walls. This essentially tripled the <br />amount of onsite storage along with deliveries of sand, gravel, rock and cement <br />by heavy delivery vehicles on an hourly basis. These deliveries by the heavy <br />trucks and construction vehicles vibrate the front of our building. Some vehicles <br />make the building and windows vibrate so much that it is hard to talk inside our <br />front offices of our building. <br /> <br />I understand there is a conditional use permit that allows this facility to operate in <br />this location, however; is the city aware that by expanding to an additional tower <br />that would increase the existing problems to a higher level. <br /> <br />Some of my concerns are listed below: <br /> <br />· Additional traffic of heavy vehicles. <br />· Is the city street 5 ton or 9 ton? (Deliveries to and from the facility come bY <br /> heavy vehicles). There is no direct access from the facility to a county road. <br />· Dirt is constantly-being pulled from the facility to the street. <br />· Dust clouds from the equipment hover over the area. <br />· Noise from the heavy vehicles vibrates and creates a hearing impairment. <br />· The builc~!'~ is a legal non-conforming structure;' by adding another tower <br /> allows additional expansion of this building. Expanding or increasing the non- <br /> conformancies? <br />· This is a constant construction area and the noise, will never stop. <br />· Dust covers all my employees cars <br />· This whole area we are in, is considered general business/light industrial. <br /> Does this business fit the zoning of the area? <br />· A variance would be needed for the. addition of the tower. Would the approval <br /> of the variance add more problems than it is worth? <br />· There are small trees on a short bu~m; they do not block any noise or visual <br /> from the operation of the facility. <br /> Equipment backup alarms are operating noise impact~- <br />· Road access to 140th or Unity, address on CUP is Unity; Sign on property is <br /> 6100 Industry, Why most deliveries to and from site off of 140Th? <br />· Outlot B?
