-250- Councilmember introduced the following resolution and moved for its adoPtion: RESOLUTION #02-09- A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST FOR A CONDITIONAL USE PERMIT FROM WAYNE AND PAMELA STEINKE TO EXCEED THE HEIGHT AND SI-ZE RESTRICTIONS FOR DETACHED ACCESSORY BUILDINGS ON PROPERTIES LOCATED WITHIN THE METROPOLITAN URBAN SERVICE AREA. WHEREAS, Wayne and Pamela Steinke, hereinafter referred to as the "Applicants," have properly applied for a Conditional Use Permit to exceed the height and size restrictions for detached accessory buildings on properties located in the Metropolitan Urban Service Area (MUSA) on the .property generally known as 15661 Juniper Ridge Drive N.W. and legally described as follows: Lot 5, Block 1, Reilley Estates, Anoka County, Minnesota ("Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That the Applicants appeared before the Planning Commission for a public hearing pursuant to Section 9.03.04 of the Ramsey City Code on August I, 2002, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated by reference. 2. That ff~e Subject Property is zoned R-1 Residential and is located within the Metropolitan Urban Service Area (MUSA). 3. That the Subject Property is approximately .7 acres in size. 4. That City Code restricts detached accessory building height to sixteen (16) feet on properties that are located within the Metropolitan Urban Service Area (MUSA). 5. That the Applicants would like to construct an accessory building that will be approximately 21 feet 5 inches in height. 6. That City Code restricts the Subject Property to a total of 1,488 square feet of accessory bUilding space. That the Applicants have a primary garage of 760 square feet; the new accessory building is proposed to be 768 square feet in size; resulting in a total of 1,528 square feet of accessory building on the Subject Property; net result is a 40 square foot overage in the 1,488 square foot limit.
