On July 26, 2002, the City received a written request from <br />Jim Nelson, Authorized Agent for Verizon Wireless, requesting an extension to initiate the <br />conditional use permit. The stated reason for the delay in initiating the construction of the <br />equipment is due to continual negotiations between the City Attorney 'and Verizon Wireless <br />regarding language in the lease agreement. City Staff and Verizon Wireless have now arrived at <br />language acceptable to both parties. A final draft of the lease agreement has been provided to the <br />City Attorney for review and approval. Due to Verizon Wireless's construction schedule, <br />construction of the cellular antenna will most likely not be able to commence prior to August 31, <br />2002 when the conditional use permit expires. City Staff is recommending approval of the <br />request for conditional use permit extension. <br /> <br />Chairperson Nixt stated he has to. recuse himself so he cannot vote. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Kociscak, to recommend that <br />City Council. grant a one-year extension to Verizon Wireless for the establishment of the <br />conditional use approved for the construction and operation of a cellular antenna on the City's <br />water tower. <br /> <br />Motion Carried. Voting Yes: Commissioners Johnson, Kociscak, Reeve, and Watson. Voting <br />No: None. Absent: None. Abstained: Chairperson Nixt. <br /> <br />Chairperson Nixt returned to his position on the Planning Commission. <br /> <br />Case #8: <br /> <br />Request for Sketch Plan Review of Town Center North; Case of Brightkeys <br />Building and Development <br /> <br />Principal Planner Trudgeon explained that Brightkeys Development Corporation has applied for <br />sketch plan review of a townhome development to plat 274 townhome units. The property is <br />located at the northwest corner of County Road 56 (Ramsey Boulevard) and County Road 116 <br />(Industry Boulevard). The subject property is-approximately 43.05 acres in size and is located in <br />the R-2 Residential District. The gross density of the proposed development is 6.13 units per <br />acre. Wetland acreage will need to be deducted in order to calculate the net density. The <br />maximum net density established in the R-2 District is 7 units per acre. The majority of the <br />townhome units will front onto private streets, which will outlet onto a public street, which will <br />provide access to County Road 116 and 149~h Ave. NW. Staff is recommending an additional <br />access from the north be provided to the lot located on the northwest comer of County Road 56 <br />and County Road 116. While it appears the development meets these specifications, detailed <br />calculations must be provided at preliminary plat submittal including the location of the required <br />common area. Since the development abuts a large-lot R-1 Single Family development to the <br />north, some type of density transition will be required. The project is subject to the review and <br />permitting process of the Lower Rum River Watershed Management Organization (WMO). The <br />Park and Recreation Commission will review the sketch plan for recommendations on park <br />dedication and trail alignment through the development. City Staff recommends sketch plan <br />approval contingent upon compliance with City Staff Review Let{er dated August 20, 2002.
