Community Development Director Frolik explained that there would be 59 units in the first phase and ultimately 126 units. Councih-nember Hendriksen asked if the balance of the units will go into Outlots A and B. Community Development Director Frolik answered in the affirmative. Motion by Mayor Gamec, seconded by Councilmember Kurak, to adopt Resolution #02-07-174 granting final plat approval to Sunflower Ridge contingent upon the Developer entering into a development agreement with the City and compliance with City Staff Review Letter dated July 18, 2002. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak and Anderson. Voting No: Councilmembers Hendriksen and Zimmerman. Case #6: Adopt Ordinances to Correct a 1997 Easement Vacation in River's Bend Community Development Director Frolik reviewed that on July 9, 2002, the City Council introduced ordinances to correct an error in a 1997 easement vacation case for Lot 45, Block 6, River's Bend. The 1997 ordinance had a typographical error which resulted in the easement vacation being recorded against Lot 46 in River's Bend. The Council introduced one ordinance to repeal the 1997 ordinance and a second ordinance to correctly apply the easement vacation to Lot 45. In accordance with the City Charter, both ordinances are now eligible for adoption. Motion by Councilmember Elendriksen, seconded by Councilmember Kurak, to adopt Ordinance #02-24 to repeal OrdinanCe #97-17 and Ordinance #02-25 to vacate a portion of the drainage and utility easement on Lot 45, Block 6, River's Bend. A roll call vote was performed by the Recording Secretary: Councilmember Hendriksen aye Councilmember Kurak aye Councilmember Zimmerman aye Councilmember Anderson aye Mayor Gamec aye Motion carried.
