stated the old ordinance was introduced previously and remains at that point so it is open for <br />adoption. But, it had been introduced and voted down. Councilmember Hendriksen stated it was <br />voted on once and voted down and then a second time Councilmembers Anderson and Kurak <br />voted against it. He stated that previously the City Attorney stated it had been introduced and <br />was available for adoption. Councilmember Zimmerman stated the new ordinance is more of a <br />screening and landscaping ordinance and has little to do with density so he would support the <br />earlier introduced ordinance. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Hendriksen aye <br />Councilmember Zimmerman aye <br />Councilmember Anderson nay <br />Councilmember Kurak nay <br />Mayor Gamec nay <br /> <br />Motion failed. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to introduce an ordinance to <br />amend Chapter 9.20. of City Code to establish density transition standards within the City. <br /> <br />Further discussion: Councilmember Anderson stated there appears to be three ordinances: one <br />discussed by the Chapter 9 Committee, one submitted by the City Attorney, and one in the <br />Council's meeting packet, but they are not the same. City Attorney Goodrich stated the most <br />recent version contains minimal grammatical changes so it reads in a more legal fashion. He <br />reviewed the changes it contained and stated it is the same document the Council has been <br />reviewing for several months but in final form. Councilmember Kurak asked if this is an <br />amendment to the ordinance which affects other parts of the City Code. City Attorney Goodrich <br />stated that is correct and the City Code needs to be amended by ordinance. Mayor Gamec stated <br />it is not known when the entire Chapter 9 will get done so they wanted to bring this forward. <br />Councihnember Kurak asked where Chapter 9 stands sinCe some zoning code changes have <br />already been made. Principal Planner Trudgeon stated it will be going into parts that have not <br />been changed. Councilmember Anderson asked about Page 2 and noted a typographic error. She <br />noted the City has three plats that had townhouses and one that had single family, all new, and <br />asked if the Council talks no transitions if they are all new between varying densities. She asked <br />if the Council talks only about old and new. Councilmember Zimmerman noted those plats have <br />already been approved. Mayor Gamec stated it is addressing if it comes against residential but <br />the proposed ordinance will allow the Council to have more leeway to work with all types. City <br />Attorney Goodrich reviewed the definition of transition, noting it does not necessarily have to be <br />"old" and "new." Principal Planner Trudgeon stated it would be applied differently if before or <br />after and the key word is "at the same time." He explained it depends on the existing adjacent <br />use and density standards would probably apply. Councilmember Zimmerman asked if there was <br />existing single family residential and then medium density at seven units per acre, could the City <br />force the developer to make a row of single family housing lots.
