Councilmember Hendriksen asked at whose option that <br />would be. Principal Planner Trudgeon stated it would be at the City's option. Councilmember <br />Hendriksen asked if the language should indicate "shall" instead of "may." Councilmember <br />Zimmerman agreed it uses the ~vord "may." City Attorney Goodrich clarified that the density <br />paragraph in question does state "shall indicate." Councilmember Zimmerman stated that does <br />not require the developer to match density, only that the City will look at it. Councilmember <br />Hendriksen stated it says the City shall indicate whether the proposed subdivision can use the <br />matching of densities. He stated that suggests the City can tell him but not that the City must. <br />Councilmember Hendriksen stated in Amendment A, Section 9.20.05, Subdivision 3, c, the word <br />"can" in the fifth line should be changed to "must." <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to amend <br />Amendment A, Section 9.20.05, Subdivision 3, c, to indicate: "...process, shall indicate whether <br />the proposed subdivision must use the..." <br /> <br />Further discussion: Councilmember Hendriksen stated this revised language will require it. <br />City Attorney Goodrich stated that would supply the City with the option. <br /> <br />Amendment carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, ZimmelTnan, <br />and Kurak. Voting No: Councilmember Anderson. <br /> <br />Further discussion: C0uncilmember Anderson stated her understanding that Municipal State Aid <br />roads would be included in Amendment A, Section 9.20.05, Subdivision 3, a, 3. Principal <br />Planner Trudgeon stated that Municipal State Aid streets should be included. Councilmember <br />Aa~derson asked about Amendment A, Section 9.20.05, Subdivision 3, a, 4, and asked if they <br />would ever be able to build on the 300 foot wide undeveloped, natural separation. Principal <br />Planner Trudgeon stated it is addressing a natural feature like a riverbed. Mayor Gamec stated <br />they also talked about the ability to control and protect that area. City Attorney Goodrich stated <br />that the very purpose of the natural areas is to leave them undeveloped..Councilmember <br />Hendriksen suggested language be added to indicate "not eligible for future development." The <br />Council agreed with that revision. Councilmember Kurak stated she understood it referred to <br />wetlands, rivers, lakes, and permanent obstructions that could never be built on. City Attorney <br />Goodrich stated that is correct and the added language assures that is the case. <br /> <br />The Council agreed to amend Amendment A, Section 9.20.05, Subdivision 3, a, 3, to include <br />Municipal State Aid Roads and Amendment A, Section 9.20.05, Subdivision 3, a, 4, to add "not <br />eligible for future development." <br /> <br />Motion carried.
