I I I I I I I I Motion by Councilmember Anderson, seconded by Mayor Gamec, to move this to Council with the recommendation they negotiate if possible, but authorize the condemnation procedure. Further discussion: Chairperson Zimmerman commented they could end up with the same costs resulting from one of the parcels they did on Highway 47 plus $4,000 for attorney fees. He suggested they work with this gentleman. Mayor Gamec stated they could not waste the time, if they left it and had to put in a 100-foot section next year they would pay double. Councilmember Hendriksen said he agrees with everything that has been said. One alternative would be to suggest that Director of Public Works Kapler talk to the gentleman. He noted this is 200 feet in the middle of a long sidewalk that has to be there for the kids. If it is necessary they would have to proceed with condemnation. Principal City Engineer Olson explained they discussed moving it a little farther away so it is not near his property, but that would be where it crosses over and would be dangerous. Councilmember Hendriksen requested this be on the agenda at the next Council meeting. Motion carded. Voting yes: Mayor Gamec, Councilmembers Anderson, Hendriksen, and Zimmerman. Votingno: None. Absent: CouncilmemberKurak. The condemnation resolution was presented to the City Council on July 23, 2002 and approved for Parcel 3 in the Public Works packet. Additional negotiations have resulted in a tentative agreement with the individual that owns parcel 3, however, we are waiting for the correct legal forms and to finalize the easement. Council Action: To ratify the recommendation of the Public Works Committee and proceed with the signing of all of the easements.
