I <br /> I <br /> I <br /> I <br /> I <br />I <br /> I <br /> i <br /> I <br /> I <br /> ! <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />Motion by Councilmember Anderson, seconded by Mayor Gamec, to move this to <br />Council with the recommendation they negotiate if possible, but authorize the <br />condemnation procedure. <br /> <br />Further discussion: Chairperson Zimmerman commented they could end up with the <br />same costs resulting from one of the parcels they did on Highway 47 plus $4,000 for <br />attorney fees. He suggested they work with this gentleman. Mayor Gamec stated they <br />could not waste the time, if they left it and had to put in a 100-foot section next year they <br />would pay double. Councilmember Hendriksen said he agrees with everything that has <br />been said. One alternative would be to suggest that Director of Public Works Kapler talk <br />to the gentleman. He noted this is 200 feet in the middle of a long sidewalk that has to be <br />there for the kids. If it is necessary they would have to proceed with condemnation. <br />Principal City Engineer Olson explained they discussed moving it a little farther away so <br />it is not near his property, but that would be where it crosses over and would be <br />dangerous. Councilmember Hendriksen requested this be on the agenda at the next <br />Council meeting. <br /> <br />Motion carded. Voting yes: Mayor Gamec, Councilmembers Anderson, Hendriksen, <br />and Zimmerman. Votingno: None. Absent: CouncilmemberKurak. <br /> <br />The condemnation resolution was presented to the City Council on July 23, 2002 and <br />approved for Parcel 3 in the Public Works packet.
