Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #11-01- <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT, <br />TO EXCEED THE TOTAL AMOUNT OF ACCESSORY STRUCTURE SQUARE <br />FOOTAGE BASED ON FINDINGS OF FACT #_ AND DECLARING TERMS OF <br />PERMIT <br />WHEREAS, on October 22, 2010, Leon Richter and Kathryn Richter (the "Permittee"), <br />properly applied for a conditional use permit for an overage in total accessory building square <br />footage established in City Code Section 117-349 on the property generally known as 8150 144th <br />Ave NW and legally described as follows: <br />Lot 1, Block 4 Alpaca Estates 3`d Addition, Subject to Easement of Record. <br />("Subject Property"); and, <br />WHEREAS, the Planning Commission met on December 2, 2010 and conducted the <br />public hearing and recommended City Council approval of the request. <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOIKA COUNTY, STATE OF MINNESOTA, as follows: <br />That based on Findings of Fact #, a conditional use permit (the "Permit") to <br />construct a 2,576 square foot, one story accessory building (the "Structure"), which will <br />result in exceeding the total amount square footage allowed by no more than 1,052 square <br />feet on the Subject Property is hereby granted to the Permittee. <br />2. That the Structure shall conform to all other requirements for accessory structures. <br />3. That the Permittee shall obtain all necessary permits prior to commencing any <br />construction of the Structure. <br />4. That no commercial or industrial activity of any type shall be permitted on the Subject <br />Property unless the necessary permits have been obtained from the City. Approval of the <br />Permit does not provide any warrant or guarantee that a home occupation will be <br />permitted on the Subject Property. The Permittee agrees to secure expressed, written <br />permission from the City prior to commencing any commercial activity. <br />5. That the Structure may not be used as a dwelling unit. <br />6. That the Permittee agrees to remove all temporary and/or membrane accessory structures <br />as well as one (1) existing 96 square foot accessory structure from the Subject Property. <br />In addition, the Permittee agrees to place an escrow or letter of credit in the amount of <br />Resolution #11-01- <br />Page 1 of 3 <br />11 <br />
