-234- <br /> <br />"Plat") contingent on certain requirements, including DEVELOPERS and CITY entering into <br />this agreement; and <br /> <br />WHEREAS, the Plat consists of two (2) lots totaling approximately 45.02 acres; and <br /> <br /> WHEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05 (Subd. 1) entitled "Division or Consolidation of platted Lots"; and <br /> <br /> WHEREAS, it is agreed between the DEVELOPERS and the CITY that the Plat is <br />being undertaken in order to assemble land for future subdivision of what will be known as Lot 1, <br />Block 1, Town Center North; and <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have been fulfilled by the DEVELOPERS. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPERS agree as follows: <br /> <br />IMPROVEMENTS AND UTD_~ITEES <br /> <br />Drainage and Utility Easements. Given the fact the Plat is only being done to assemble <br />the land for a future townhouse subdivision, staff' is waiving the requirement the <br />requirement that the developer show the standard 10 foot (5 foot on common property <br />lines) drainage and utility easements on the final plat. Appropriate easements will be <br />required once the property is resubdivided. <br /> <br />Sewer and Water Trunk Fees. At this time it is not anticipated that any new residences <br />will be built as part of the Plat. Therefore, the DEVELOPERS shall not be responsible <br />for sewer and water trunk-fees at this time. The Sewer and Water Trunk Fees shall be <br />charged per the fee schedule in effect at the time when the Subject Property is <br />resubdivided. Payment of the Sewer and Water Trunk fees for the new subdivision shall be <br />paid to the City prior to releasing the Final Plat of the future subdivision for recording. If <br />the property is not resubdivided, the fee' shall be paid as part of the building permit <br />application. <br /> <br /> IL <br />PARKS, TRAILS, STORMWATEI~ LANDSCAPING <br /> <br />Park Dedication. The Plat is in the Greenland Hills Park District. At this time it is not <br />anticipated that any new residences will be built as Part of the Plat. Therefore, the <br />DEVELOPERS shall not be responsible for park dedication fees at this time. Any fees <br />required shall be charged when the Subject Property is resubdivided.
