I0

PROPOSAL OF RIGHT OF WAY PERMIT FEES AND ASSOCIATED COSTS
By: Dean Kapler, Director of Public Works

Background:

At the March 19, 2002 Public Works Committee meeting, details of the ROW permit
fees, associated costs and late fees were discussed. Staff has implemented the directed
changes to the rates and fees. These changes are reflected in the attached schedule. The
city attorney was also asked to review the policy. This has been done and the city
attorney finds the policy acceptable.

Recommendation:

Staff is recommending the following:

Permit fee for boring and open trench:

$75 permit fee plus
$15/driveway, $20/road crossing plus
$10,000 bond per mile

Permit £ee for overhead:

$75 permit fee plus
$.05/linear foot

A late fee of $50 per day will be charged for any work not completed satisfactorily within
the agreed time limit per the permit.

Being the County and State both have permit processes, work being done in County and
State ROW would not be required to have a City permit and would not be assessed late
fees by the City.

Again if possible all work in existing ROW would require boring, with new construction
trenching would be allowed.

Council Action:

Approve/disapprove staff's recommendation for ROW permit fees, including amending
2002 rates and charges and adopt resolution #0207-XXX.

Reviewed by:
City Administrator
Director of Public Works
City Engineer

CC 07/09/2002

-117-
