-60- City Attorney Goodrich stated they were obligated to grant final plat approval as described in State Statute. He read from State Statute 462.358. Councilmember Anderson asked if their code was applicable to the entire pond area. City Attorney Goodrich stated it was. Councilmember Anderson asked if the peninsula was .going to be subject to the environmental rules. City Attorney Goodrich stated this was true and there were certain things in the development agreement which the developers agreed to and they reviewed the ordinance agreement with City consultants. He stated they were talking about a year and what they were required to do in regard to the preliminary plat. He stated the original preliminary plat was not correct when submitted and was approved. He stated it was open for the Council to decide at what Point they were considering the actual preliminary plat. He stated the Council should move forward and not look back. Mr. Mike Ingles, 5751 145~ Court, stated this would affect him the most. He stated he did not understand the grading.
