Voting Yes: Mayor Gamec, Councilmembers Kurak, and Anderson. Voting
No: Councilmembers Hendriksen and Zimmerman.

Case #2: Request for Preliminary Plat of The Ponds; Case of Royal Oaks Realty

Principal Planner Trudgeon stated Royal Oaks Realty has resubmitted a preliminary plat showing
the development of 86.71 acres at the comer of Dysprosium Street and Nowthen Boulevard.
Royal Oaks Realty is proposing to develop 88 single-family lots, 91 townhome units and 82 senior
apartment units for a total of 261 housing units on this property. The applicant previously
submitted a preliminary plat in Spring 2001, for consideration. The original preliminary plat was
proposed as a Planned Unit Development (PUD) which had 73 single family lots, 152 townhome
units, and 82 senior apartment units for a total of 307 housing units. Along with the preliminary
plat, Royal Oaks Realty has submitted a rezoning request (from B-I Business and R-1 Single
Family to R-1 Single Family Residential, R-3U Residential, and Multiple Residential) and a
townhouse site plan review request. The site plan for the apartment building has not changed-
from the original application. The apartment site plan as well as the height variance appeal needs
to be reviewed by the City Council. The property is currently zoned R-1 Single Family and B-1
Business. As mentioned above, the applicant is asking for a rezoning to R-I, R-3U, and MR.
The adopted Comprehensive Plan shows approximately 7.52 acres of this property being High
Density Residential, 13.52 acres being Medium Density Residential and 65.67 acres as Low
Density Residential. The following table indicates how much of each type of density is allowed on
the development property as directed by the newly adopted Comprehensive Plan.

Area in Acres 65.67 13.52 7.52 86.71
Wetlands 24.67 3.04 .31 28.02
Net Area 41.00 10.48 7.21 58.69
Maximum 3 (4 with P.~J.D.) 7 15 ' NA
Density
# of units allowed 123 73 108 304

City Council/February 12, 2002

-165-
