Since this will not be a Planned Unit Development, this transfer of density, if <br />allowed, would need to be addressed in the development agreement. The single-family lots abut <br />urban size residential lots to the north and west and two large single family lots to the south that <br />are buffered by wetlands. The single-family lots all meet the standard minimum dimensional and <br />area requirements. Many of the single-family lots are subject to regulations governing shorelands. <br />These lots all meet the dimensional and lot width requirements for the Shoreland District. The <br />townhomes will be adjacent to the new single-family lots and a large single-family lot along <br />Nowthen Boulevard. The apartments will be across the street from the existing senior's <br />apartment building. The development will gain primary access from Nowthen Blvd. and <br />secondary access from Iodine Street NW. As part of the plat, 145t~ Court will be extended <br />another 200 feet to serve additional lots being created as part of the plat. The preliminary plat <br />does not show any proposed access to or from the subdivision using Fluorine Street NW The <br />development is proposing to use Outlot A and B of Wood Pond Hills 4th Addition in combination <br />with land on the development property to create 7 new single family lots and complete 145th <br />Court. Two existing lots on the south side of 145t~ Court are shown as receiving additional land <br />in their rear yards. The plat shows three outlots. Outlot A is located across Nowthen Blvd. and <br />currently has the Lord of Life Church sign on it. The applicant is planning on deeding Outlot A to <br />the church. Outlots B and C are planned to be deeded to the two property owners on 145~ Court <br />as shown. The drives serving the townhomes are a combination of private and public roads. The <br />public roads will consist of 144m Lane, 144~ Court and Iodine Street. The applicant is dedicating <br />60 feet of right-of-way for the public streets through the townhouse portions of the development. <br />The remaining townhouse units will be served by driveways coming off the public roads. As the <br />City Council knows, the City has been reviewing use of private roads in multi-family <br />developments. This plan appears to comply with the policies that the City Council has discussed. <br />The public/private road policy anticipates reduced setbacks for those townhouse units located on <br />public streets. The townhouse units along public streets will be set back 25 feet from the right-of- <br />way (approximately 40 feet from back of street curb) and the units located on the private streets <br />will be located 25 feet from back of street curb. All of the units will have driveways at least 25 <br />feet in length. Staff has reviewed the proposed setbacks for the townhouse units from the road <br />and found them acceptable. The sidewalk ordinance calls for sidewalk to be installed on all roads <br />except cul-de-sacs. The developer has indicated in written correspondence that they will comply <br />with City Ordinances. Sidewalk on one side of the street will be required on Iodine Street, <br />Fluorine Court, 143'a Lane, 144th Lane, and 144th Circle. The grading and drainage plan is <br />generally acceptable. However, there are several issues covered in the staff review letter that will <br />need to be addressed. The Lower Rum River Water Management Agency (LRRWMO) will <br />require a permit for the stormwater drainage into the wetlands. This permit will also address the <br />adequacy of the erosion control measures during construction. The Park Commission met on <br />Thursday, January 10, 2002 ,to review the preliminary plat. The Commission decided to accept <br />park dedication as a combination of cash and land dedication. The land dedication will be as <br />shown on the preliminary plat except for the trail corridor going east to Dysprosium will be <br />enlarged to 35 feet in width. Preliminary comments from Mark Boos, Parks/Utilities Supervisor, <br />regarding park dedication and trail issues are contained in the staff review letter. During the <br />Planning Commission and City Council meetings in June 2001, concerns were raised by residents <br />of 145u~ Court regarding the buildability of Lot 2, Block 1. The residents were concerned that the <br />lot was configured in such a way that only a very small house could fit on the lot.
