City Attorney Goodrich recommended that if the Council is inclined to grant preliminary plat <br />approval he would recommend that the motion include the following language: "..approve <br />preliminary plat, which reduces two lots in Block 2 and Block 3,.." and "..in addition the <br />developer shall not be permitted to grade within the plat area except in the proposed right of ways <br />prior to Phase I of the biological survey is completed, after which time the developer shall comply <br />with the requirements of the said biological survey." <br /> <br />Fredrick, 14569 Iodine Street NW, Ramsey, stated that as someone with a 2 ½ year old he is very <br />concerned with the additional traffic. He felt that there were too many kids along Iodine Street to <br />take the issue for granted. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution <br />#02-02-041 approving the preliminary plat, which reduces two lots in Block 2 and Block 3, <br />subject to the City staff'review letter dated December 28, 2001, the rezoning of the parcel to R-I, <br />R-3U, and Multiple Residential, and completion of a biological survey to determine the existence <br />of Blandings Turtles on the property. In addition, the developer shall not be permitted to grade <br />within the plat area except in the proposed fight of ways prior to Phase I of the biological survey <br />being completed, after which time the developer shall comply with the requirements of the said <br />biological survey. <br /> <br />Further discussion: Councilmember Zimmerman did not feel that the traffic concerns had been <br />addressed. He stated that the developer may have agreed to reduce two lots along the pond, but <br />those lots probably should have not been included to begin with. He also felt that the "doghouse" <br />lot would continue to be an eyesore in the neighborhood. Councilmember Hendriksen stated that <br />the fact that the development is not as bad as it could have been only means that the <br />Comprehensive Plan is not as good as it should have been. He inquired if the motion addressed <br />the withdraw of the apartment complex and the creation of that lot as an outlot. City Attorney <br />Goodrich inquired if the preliminary plat included the apartment building. Principal Planner <br />Trudgeon replied that preliminary plat only creates the lots. Mr. Black noted that he was not <br />going to be requesting site plan approval on~ the apartment lot at this time. Councilmember <br />Anderson inquired at what time would it be appropriate to draft the reforestation agreement. City <br />Attorney Goodrich replied that reforestation should be addressed in the development agreement. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, and Anderson. Voting <br />No: Hendriksen and Zimmerman. <br /> <br />Case #3: <br /> <br />Request for Site Plan Review for Townhomes located within The Ponds <br />Subdivision; Case of Royal Oaks Realty <br /> <br />Principal Planner Trudgeon stated that Royal Oaks Realty, Inc. has applied for site plan review <br />for a townhome development to be located within The Ponds subdivision. The applicant is <br />planning on constructing 91 townhome units. The town.house development is generally located <br />along CSAH 5 (Nowthen Blvd.) northwest of the City Water Tower. The applicant has submitted <br />an application for the rezoning of the development property from B-l, Business and R-l, Single- <br />Family Residential to R-1 Single Family Residential, R-3U, Multi-Family Residential, and MR, <br /> <br />City Council/February 12, 2002 <br /> Page 23 of 33 <br /> <br />-175- <br /> <br /> <br />
