I <br />I <br />I <br />I <br /> <br />I <br />i <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />City Attorney Goodrich replied that at this time that is the only thing the Council can require, at <br /> <br />Councilmember Anderson stated that Mr. Black agreed that he would put the reforestation <br />agreement in writing. <br /> <br />City Attorney Goodrich inquired if reforestation was ever defined. <br /> <br />Principal Planner Trudgeon replied no. <br /> <br />City Attorney Goodrich inquired if Mr. Black had stated at a Council meeting that he would agree <br />to a reforestation plan. <br /> <br />Mike Black, Royal Oaks Realty, replied yes. <br /> <br />City Attorney Goodrich inquired as to what the parameters of the plan was. <br /> <br />Mr. Black replied that it was his intention to replant trees on the site, and comply with City <br />ordinance regarding the planting of new trees and the landscaping for the townhomes. <br /> <br />City Attorney Goodrich inquired if that is what is included in the development agreement. <br /> <br />Principal Planner Trudgeon replied yes. <br /> <br />City Attorney Goodrich inquired if Councilmember Anderson felt that there were any other <br />requirement agreed to other than what was stated. <br /> <br />Councilmember Anderson replied no. <br /> <br />Councilmember Kurak noted that the Parks/Utilities Supervisor did go to the site and mark the <br />trees that were to be saved. <br /> <br />Parks/Utilities Supervisor Boos stated that he is a big advocate for tree preservation and the <br />Royal Oaks development met all the minimums of the tree conservation policy. Mr. Black also <br />exceeded the requirements from the initial discussions with staff and Park Commission. He <br />explained that an attempt was made to salvage trees in areas that would have less then two feet of <br />grade change and four feet of fill. The developer did relocate 30 to 50 scotch pines, which Could <br />be as part of a reforestation, and would be considered preservation. He stated that he did believe <br />that reforestation did occur. Mr. Boos explained that Mr. Black spent in excess of 16 hours to <br />relocate trees most of them landing on public property, which was not a requirement of <br />preliminary plat, <br /> <br />City Attorney Goodrich inquired if Mr. Boos felt that Mr. Black had lived up to his word to the <br />Council in regards to reforestation. <br /> <br />Parks/Utilities Supervisor Boos replied that he exceeded the minimums. <br /> <br />City Council/May 14, 2002 <br /> Page 14 of 33 <br /> <br />-183- <br /> <br /> <br />
