-184- <br /> <br />City Attorney Goodrich reviewed development agreement as it pertains to environmental <br />protection and inquired if Mr. Boos felt that Mr. Black had complied. <br /> <br />Parks/Utilities Supervisor Boos replied that the development meets all the requirements. <br /> <br />City Attorney Goodrich stated that the Council is requiting as much of the developer as City <br />Code will allow them to require. He noted that the Council does have the authority to place in a <br />development agreement anything that is permitted in City Code. <br /> <br />Councilmember Anderson stated that it was her understanding that drainage of the plat has a lot <br />to do with what trees can be saved and what has to be cut. <br /> <br />City Engineer Jankowski replied that drainage does impact tree preservation to some degree, but <br />noted there are many things that come into play, such as the natural grounds versus the proposed <br />ground level and the type of house that is placed on a lot. <br /> <br />Councilmember Anderson inquired if there are thing they can do to improve the City's grading <br />requirements to make things better. <br /> <br />City Engineer Jankowksi replied that if the City were to have some type of tree preservation <br />ordinance they would have to do a survey and identify trees that would be desirable to be saved <br />and incorporate them very early in the design process. <br /> <br />Councilmember Kurak stated that those were the issues they were going to have the <br />environmental task force work on. <br /> <br />Motion by Councilmember Kurak, seconded by Mayor Gamec, to adopt Resolution #02-05-_ _. <br />granting final plat approval to The Ponds subdivision contingent upon compliance with the' Ci~ <br />staff review letter dated May 9, 2002 and the Developer entering into a development agreement <br />with the City. <br /> <br />Further discussion: Councilmember Hendriksen stated that the lesson learned is that when a <br />developer comes before them for an approval they will pick and choose their words that they <br />decide to follow through. They need to make sure that the new ordinances demand the vision of <br />what they want to see and the ordinances they have allow the quality of life to be preserved in <br />Ramsey. When they have the higher densities they can not save much in the way of trees and <br />quality of life because the likelihood of saving the trees and relocating of trees is unlikely. <br />Councilmember Zimmerman stated that he had a problem with the "dog house" lot because there <br />is no backyard. Also during the preliminary plat process there were residents that were concerned <br />about the additional traffic coming into their neighborhood. He felt that they could have designed <br />the development without intruding on the next door neighbors. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, and Anderson.
