-294- <br /> <br />Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #02-06- <br /> <br />A RESOLUTION APPROVING/DENYING THE ISSUANCE OF A VARIANCE TO <br />CONSTRUCT A GARAGE ON A CORNER LOT AT 15920 RADIUM STREET N.W. <br />THAT WILL ENCROACH ON THE SIDE YARD SETBACK. <br /> <br /> WHEREAS, Gene and Laurie Ronallo (Permit-tees) have properly applied for a variance <br />from Section 9.20.11 of the Ramsey City Code to construct an accessory structure that will <br />encroach on the side yard setback requirements on a coruer lot generally known as 15920 <br />Radium St. N.W. and legally described as follows: <br /> <br />Lot 5, Block 1, Oak Run, Anoka County, Minnesota <br />(the "Subject Property") <br /> <br /> AND WHEREAS, the Board of Adjustment conducted a public hearing on June 6, 2002, <br />pursuant to Section 9.03.05 of the Ramsey City Code; and <br /> <br /> WHEREAS, the Board of Adjustment adopted findings of fact and denied the request for <br />a variance on June 6, 2002; and <br /> <br /> ~TIEREAS, on June 17, 2002, Gene and Laurie Ronallo submitted a written request for <br />an appeal to the decision of the Board of Adjustment. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That based on Findings of Fact #0 , a variance to construct an accessory structure nearer <br />the side property line (159~'' Lane N.W. right-of-way line) than the setback of the principal <br />structure on the adjacent property to the west is hereby denied. <br /> <br />-or- <br /> <br />That based on Findings of Fact #0 , a variance to construct an accessory structure nearer <br />the side property line (159* Lane N.W. right-of-way line) that the setback of the principal <br />structure on the adjacent property to the west is hereby granted. <br /> <br />2. That the Permit-tee shall maintain a minimum <br /> of the Subject Property. <br /> <br />foot setback from the south property line <br /> <br />3.
