-294- Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #02-06- A RESOLUTION APPROVING/DENYING THE ISSUANCE OF A VARIANCE TO CONSTRUCT A GARAGE ON A CORNER LOT AT 15920 RADIUM STREET N.W. THAT WILL ENCROACH ON THE SIDE YARD SETBACK. WHEREAS, Gene and Laurie Ronallo (Permit-tees) have properly applied for a variance from Section 9.20.11 of the Ramsey City Code to construct an accessory structure that will encroach on the side yard setback requirements on a coruer lot generally known as 15920 Radium St. N.W. and legally described as follows: Lot 5, Block 1, Oak Run, Anoka County, Minnesota (the "Subject Property") AND WHEREAS, the Board of Adjustment conducted a public hearing on June 6, 2002, pursuant to Section 9.03.05 of the Ramsey City Code; and WHEREAS, the Board of Adjustment adopted findings of fact and denied the request for a variance on June 6, 2002; and ~TIEREAS, on June 17, 2002, Gene and Laurie Ronallo submitted a written request for an appeal to the decision of the Board of Adjustment. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That based on Findings of Fact #0 , a variance to construct an accessory structure nearer the side property line (159~'' Lane N.W. right-of-way line) than the setback of the principal structure on the adjacent property to the west is hereby denied. -or- That based on Findings of Fact #0 , a variance to construct an accessory structure nearer the side property line (159* Lane N.W. right-of-way line) that the setback of the principal structure on the adjacent property to the west is hereby granted. 2. That the Permit-tee shall maintain a minimum of the Subject Property. foot setback from the south property line 3.
