-304-

Mr. 3W__tke Rolfe, 634t - 172nd Lane N'.W., stated that a mining permit will mean that there will be
a gravel pit. He asked for assurance that there will be no production of crushed rock material,
bituminous or ready mix materia/s.

Nit, Thompson stated that he is not setting up asphalt production. I-lis proposal is to level the hill.
The elevation is currently at 899, and he proposes to cut 2 down to 874. The inished elevation is
estimated to be 87t for a relatively fiat site w/th a 1 percent slope to the adjacent wetland. There
will be no separating of soils, no rock crushing and no asphalt batch plant.

Nh-. Thompson's next door neighbor asked what the working hours would be for th/s project.

City, Engineer Steve lznlzowski stated that working hours are specified by City ordinance and in
the permit to be 7:00 a.m. to 8:00 p.m.

Nfr. Thompson's neighbor asked if there would be work on Saturday and Sunday.

Commissioner Deemer stated that no work would occur on Saturday a.nd/or Sunday unless it is
specifically approved by the City.

Zoning Adm/~strator Frolik noted that the City code does not prohibit Saturday work hours.

Mr. Thompson's neighbor asked if the work hours could be limited to normal business hours
because the work hours should con.form to what is acceptable to adjacent residents.

Mr. Thompson stated that he does not yet .have a contractor to buy the fill. The reason he
requested a 5-year permit is that it may take to three years to market the soil properly, The
purchase agreement for the fill will stipulate its use.

Commissioner HoLland asked if Mr. Thompson would agree to working hours bet-ween 8:00 a.m.
and 6:00 p.m.

Mr. Thompson stated that he would prefer to be able to work until 8:00 p.m.

M.r. Thompson's neighbor expressed concern about noise control, erosion control and restoration
control.

Mr. Thompson stated that his proposal [s to not have more than 50 percent of the site bare with
the top soil removed at any one time. Top soil w/ii be stock piled on the north slope of the hill.
ARer the first 50 percent is excavated, the top soil w/il be put back.

CiU Engineer lankowski stated that conditions need to be added to the final plan. The erosion
control plan of a s/It fence must be maintained or a secondary erosion control measure added
when more than 50 percent of ill/is removed.

Public Vrearing/Planning Commission/February 4, 1997
Page 2 of 4

I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
.

i
