3) Council Update <br /> <br /> Councitmember Hendriksen stated that Councitmember Anderson did the Council Update last <br /> time and when it came to all of the development projects, she correctly reported that they had <br /> been approved and that there was a 3/2 vote. Councilmember Anderson then proceeded to say <br /> that "Jerry and Terry don't like town_houses." Councitmember Hendriksen stated he believes that <br /> comment is where it crossed the line. He stated he didn't like that project for a number of <br /> reasons: the regulation imposed on the number of units per acre, a serious lack of parking, the <br /> setbacks, and a number of things. Councilmember Hendr/ksen stated he voted for Mallard Ponds <br /> which included townhouse units. He stated he did not want to make a big issue of this but, <br /> maybe, "Terry doesn't like your definition of townhouses, requirements for setbacks, and <br /> densities." However, that doesn't mean "Terry doesn't like townhouses." <br /> Councilmember Anderson stated she doesn't remember saying that and advised that she had <br /> received a very short notice to do the Update. She stated if that is what she said, she would try <br /> not to bring it up again. <br /> Councilmember Zimmerman stated he is quite liberal about what is said during the Council <br /> Update but, perhaps, Councilmember Anderson should have indicated "it's my opinion." <br /> Councilmember Anderson stated she did not intend it to be a "slam." <br /> Councilmember Zimmerman stated it may have been construed to be a "slam" in someone else's <br /> opinion. <br /> <br />4) Contract Zoning <br /> <br /> Councilmember Hendriksen stated during the discussion of contract zoning it was clear that <br /> some members of the Kurak family .feel they are being asked to do more than any one else in <br /> terms of their particular request for a land use change; or, perhaps, that they are being <br /> disadvantaged and having to do more. Councilmember Elendriksen stated that personally, he <br /> thinks they are being given latitude that has and would not be extended to others. He stated the <br /> truth may lie somewhere in-between there. Councilmember Hendriksen stated he is asking to <br /> have something done to assure that if the Council continues to offer extensions to try to achieve <br /> some kind of consensus with the surrounding neighborhood, that we not be penalized in the <br /> event that they (the Kuraks) do not actually achieve that consensus. He referred to the comment <br /> that "no good deed goes unpunished" and indicated he thinks, for whatever reason, they (the <br /> Kuraks) are being given more and more opportunity to achieve some kind of a consensus and he <br /> does not want, having done that good deed, to have it come back and bite us in some future <br /> litigation should it become a litigious situation.
