But, rather, an opportunity to achieve a consensus as <br />opposed to a requirement thrust upon them. That they understand it is being done to benefit <br />them, not to benefit the City. The second issue is that should that fail, he would like to have the <br />information and documentation included in the case such as would be necessary to take final <br />action which is required within the scope of the ordinance and State Statute that has been <br />extended multiple times. <br /> <br />Councilmember Anderson asked why the Council would be taking up an issue on a specific <br />parcel and commented that it sounds like Councilmember Hendriksen wants to single out one <br />parcel for discussion. However, the objection is treating one party differently than another. <br /> <br />Councilmember Hendriksen stated that during the discussion of contract zoning, he thought he <br />heard a statement from Councilmember Kurak indicating something about they were being <br />unfairly disadvantaged in that process in that they were being asked to do things that others had <br />not been asked to do. Councilmember Hendriksen stated it is his personal opinion that they (the <br />Kuraks) are being benefited and given every opportunity possible to achieve a consensus with the <br />neighborhood. However, if they don't get what they want, it sounded to him like there may be <br />some person or persons who will claim they were asked to do things that others have not been <br />asked to do. He stated he wants a discussion that if the City continues with the process for staff <br />to meet with them and the ne!ghborhood, that they acknowledge the purpose is to benefit the <br />resolution of the situation, so that everyone gets what they want and it is not perceived to be. an <br />added hurdle thrust upon them to their disadvantage. Councilmember Hendriksen stated the <br />Council needs to be prepared to take action on their land use request if they believe they are <br />being intentionally or unintentionally disadvantaged through this process by being asked to do <br />things that others are not asked to do. <br /> <br />Mayor Gamec asked who else has been asked to do this. <br /> <br />Councilmember Hendriksen stated he may not know the history but believes that anyone who <br />asks to do what they are asking may probably be allowed to do it, but he is concerned it may be <br />getting into some litigation and he wants it looked at. <br /> <br />Mayor Gamec stated that Councilmember Hendriksen has stated he doesn't know the history but <br />has served on the Planning Commission for years, and on the Council, and goes back on the <br />history and knows all this stuff.
