Proper notice was published in the Anoka County Union, consistent with State statutes, calling December 14, 2010 <br />as the public hearing date on this matter. <br />Observations: <br />Since the developer is the only benefitting petitioner and wants to take advantage of the competitive bidding <br />environment, they are waiving their 60 day waiting period for the ability to counter petition the improvements in <br />the language of the Development Agreement. <br />Recommendation: <br />Staff recommends holding the public hearing, approve the feasibility study for the infrastructure improvements <br />associated with the Legacy Christian Academy project, and order the project by authorizing Staff to issue an RFP <br />for design services. <br />Funding Source: <br />Funding for most of these improvements is being assessed to the applicant as outlined above, with a portion being <br />paid by the City. Funding and sources will be outlined in the Feasibility Study. The cost for design services to <br />incorporate the infrastructure that was petitioned is expected not to exceed $106,000.
