Councilmember Hendriksen stated that there were 12 or 14 changes to the <br />Comprehensive Plan, which include areas with a substantial amount of trees and most requests <br />were for a higher density so he thought it was appropriate they prepare the moratorium for the <br />next Council meeting. <br /> <br />Motion failed. Voting Yes: Councilmembers Hendriksen, and Zimmerman. Voting No: Mayor <br />Gamec, Councilmembers Anderson, and Kurak. <br /> <br />Case #2: <br /> <br />Adopt Ordinance to Rezone Property from R-1 Residential and B~I Business <br />to R-1U Urban Residential, R-3 Urban Residential, and Multiple Residential; <br />Case of Royal Oaks Realty <br /> <br />Principal Planner Trudgeon stated that Royal Oaks Realty has submitted an application to rezone <br />property located at the southwest comer of CSAH #5 and Dysprosium Street from B-1 Business <br />and R-1 Single Family Residential to R-1 Single Family Residential, R-3U Residential, and <br />Multiple Residential. The rezoning would allow the property to be subdivided for 86 single- <br />family lots, 91 townhome units and a lot for apartment units. The City Council adopted findings <br />of fact and introduced the ordinance to rezone the property on February 12, 2002. <br /> <br />Councilmember Hendriksen inquired if the rezoning required a 4/5ths majority vote. <br /> <br />City Attorney Goodrich replied no. <br /> <br />Councilmember Zimmerman inquired if the plan still included the dog house lot. <br /> <br />Principal P tanner Trudgeon explained that the rezoning does include the peninsula, noting that it <br />was already zoned R-IU. <br /> <br />Councilmember Zimmerman inquired if staff had researched if the "dog house" lot is buildable. <br /> <br />Principal Planner Trudgeon replied yes. <br /> <br />Councilmember Zimmerman inquired as to how much fill would have to be brought in to make <br />the lot buildable. <br /> <br />Principal Planner Tmdgeon replied that he was not sure. <br /> <br />Councilmember Zimmerman stated that he thought six to eight feet of fill was needed. <br /> <br />Councilmember Kurak stated that she viewed the site with the developer and City staff and it <br />was noted that the homes that currently exist required 10 feet of fill to be brought in. <br /> <br />City Council/May 14, 2002 <br />Page 11 of 33 <br /> <br />-67- <br /> <br /> <br />
