-68- <br /> <br />Councilmember Zimmerman stated that he felt the lot was deficient and should be adjoined with <br />the neighboring lot. <br /> <br />Councihnember Hendriksen inquired as to how many inches or feet can they fill before any trees <br />are killed. <br /> <br />Councilmember Zimmerman replied that it varied with the species of trees. <br /> <br />Councilmember Hendriksen stated that he has been told that any more than a few inches will kill <br />trees so ten inches of fill would kill all the trees. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Ordinance <br />#02-05~__ rezoning property contained in the proposed plat of The Ponds from B-1 Business <br />and R-I Single Family Residential to R-1 Single Family Residential, R-3U Residential, and <br />Multiple Residential. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councihnember Anderson aye <br />Councilmember Kurak aye <br />Councilmember Zimmen'nan nay <br />Councilmember Hendriksen nay <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #3: Request for Final Plat Approval of The Ponds; Case of Royal Oaks Realty <br /> <br />Principal Planner Trudgeon stated that on February 12, 2002, Royal Oaks Realty received <br />preliminary plat approval for the subdivision of their property generally located along Nowthen <br />Blvd. (CSAH 5) and Dysprosium St. The property is approximately 86.71 acres in size and the <br />approved preliminary plat consisted of 86 single family lots and 91 townhome units. Royal Oaks <br />Realty will be submitting two final plats for consideration; The Ponds and The Ponds 2nd <br />Addition. The Ponds final plat consists of 79 single-family lots and 91 townhome lots, as well as <br />a large lot for a fitture apartment building. The Ponds 2''a Addition consists of 7 single-family <br />lots located on the peninsula of 145th Court and will be considered at a later date. The Ponds <br />final plat shows 79 single family lots, 91 townhome lots, and one 4,41 acre lot (Lot 1, Block 9) <br />for future development of an apartment building. Lot 1, Block 9 will not be allowed to be <br />developed until the City grants site plan approval of an apartment building. In addition, The <br />Ponds final plat shows two outlots, Outlot A, a small parcel on the north side of Nowthen Blvd. <br />that will be deeded to Lord of Life; and Outlot B, which will be final platted as The Ponds 2nd <br />Addition. In accordance with the approved preliminary plat, Royal Oaks Realty has removed <br />two single-family lots backing up to the existing trail easement.
