-70- <br /> <br />Councilmember Anderson replied that if they delay the project two more lots will be added along <br />the wetland. A number of rights go to the developer when preliminary plat is granted and the <br />developer already has that. <br /> <br />Councilmember Hendriksen stated if preliminary plat is a final approval then they would not <br />have to come back for final plat approval. <br /> <br />City Attorney Goodrich noted that the Council can only require what they have the authority to <br />require. He explained that the Council can only can require what is included in City Code and <br />there is cun'ently no requirement Ibr reforestation. <br /> <br />Principal Planner Trudgeon noted that they do require one two-inch tree for every lot. <br /> <br />City Attorney Goodrich replied that at this time that is the only thing the Council can require, at <br /> <br />Councilmember Anderson stated that Mr. Blacl~ agreed that he would put the reforestation <br />agreement in writing. <br /> <br />City Attorney Goodrich inquired if reforestation was ever defined. <br /> <br />Principal Plarmer Trudgeon replied no. <br /> <br />City Attorney Goodrich inquired if Mr. Black had stated at a Council meeting that he would <br />agree to a reforestation plan. <br /> <br />Mike Black, Royal Oaks Realty, replied yes. <br /> <br />City Attorney Goodrich inquired as to what the parameters of the plan was. <br /> <br />Mr. Black replied that it was his intention to replant trees on the site,-and comply with City <br />ordinance regarding the planting of new trees and the landscaping for the townhomes. <br /> <br />City Attorney Goodrich inquired if that is what is included in the development agreement. <br />Principal Planner Trudgeon replied yes. <br /> <br />City Attorney Goodrich inquired if Councilmember Anderson felt that there were any other <br />requirement agreed to other than what was stated. <br /> <br />Councilmember Anderson replied no. <br /> <br />Councihnember Kurak noted that the Parks/Utilities Supervisor did go to the site and mark the <br />trees that were to be saved. <br /> <br />City Council/May 14, 2002 <br />Page 14 of 33 <br /> <br />I <br /> <br />I <br /> <br /> <br />
