Mr. Black also <br />exceeded the requirements from the initial discussions with staff and Park Commission. He <br />explained that an attempt was made to salvage trees in areas that would have less then two feet of <br />grade change and four feet of fill. The developer did relocate 30 to 50 scotch pines, which could <br />be as part of a reforestation, and would be considered preservation. He stated that he did believe <br />that reforestation did occur. Mr. Boos explained that Mr. Black spent in excess of 16 hours to <br />relocate trees most of them landing on public property, which was not a requirement of <br />preliminary plat. <br /> <br />City Attorney Goodrich inquired if Mr. Boos felt that Mr, Black had lived up to his word to the <br />Council in regards to reforestation. <br /> <br />Parks/Utilities Supervisor Boos replied that he exceeded the minimums. <br /> <br />City Attorney Goodrich reviewed development agreement as it pertains to environmental <br />protection and inquired if Mr. Boos felt that Mr. Black had complied. <br /> <br />Parks/Utilities Supervisor Boos replied that the development meets all the requirements. <br /> <br />City Attorney Goodrich stated that the Council is requiting as much of the developer as City <br />Code will allow them to require. He noted that the Council does have the authority to place in a <br />development agreement anything that is permitted in City Code. <br /> <br />Councilmember Anderson stated that it was her understanding that drainage of the plat has a lot <br />to do with what trees can be saved and what has to be cut. <br /> <br />City Engineer Jankowski replied that drainage does impact tree preservation to some degree, but <br />noted there are many things that come into play, such as the natural grounds versus the proposed <br />ground level and the type of house that is placed on a lot. <br /> <br />Councihnember Anderson inquired if there are thing they can do to improve the City's grading <br />requirements to make things better. <br /> <br />City Engineer ,Jankowksi replied that if the City were to have some type of tree preservation <br />ordinance they would have to do a survey and identify trees that would be desirable to be saved <br />and incoqoorate them very early in the design process. <br /> <br />Councilmember Kurak stated that those were the issues they were going to have the <br />environmental task force work on. <br /> <br />Motion by Councihnember Kurak, seconded by Mayor Gamec, to adopt Resolution #02-05- <br />granting final plat approval to The Ponds subdivision contingent upon compliance with the City <br /> <br />City Council/May 14, 2002 <br />Page 15 of 33 <br /> <br />-71- <br /> <br /> <br />
