-170- <br /> <br />Final Plat Review: Birch Hili Lodges <br />Page 2 of 3 <br />March 22, 2002 <br /> <br />to determine where the watermain looping easement should be located and is subject to the City <br />Engineers approval. <br /> <br />Final Grading, ,Construction, Street.s and Utility Plan: In conjunction with final plat review <br />the City Engineer has reviewed the final grading, construction, streets and utility plan. The City <br />Engineer has provided comments in the attached letter addressed to Mr. Kurt Quantance dated <br />April 5, 2002. <br /> <br />It is noted that the applicant will need to obtain a grading easement from the Lord of Life Church <br />in order to accomplish the proposed grading plan submitted to the City.. A copy of the agreement <br />between Orrin Thompson Homes and Lord of Life Church for a grading easement to be located <br />on a portion of the Lord of Life church's property will need to be received bythe City prior to <br />commencement of any grading on the property. In the event that Orrin Thompson Homes and <br />Lord of Life Church cannot come to an agreement on a grading easement located on a portion of <br />the Lord of Life church's property; Orrin Thompson Homes will need to submit a revised <br />grading plan to the City providing for the construction of a retaining wall along the southeastern <br />boundary line of the plat. The construction of the retaining wall is subject to the review and <br />approval of the City Engineer. <br /> <br />Sound Mitgation: The final grading plan is proposing to construct a berm and sound wall <br />around e,'dsting mature trees along State High. way #47 in order to comply with Minnesota <br />Pollution Control Agencies noise level standards. Staff is in receipt of a report addressing the <br />sound mitigation issue. The report has been forwarded to SRF consulting firm to review and <br />provide the City with any further sound mitigation recommendations. In the event that further <br />sound mitigation measures will need to be taken, a revised final grading plan will need to be <br />submitted to Staff prior to .recording the plat. <br /> <br />Park Dedication: The final plat is proposing to dedicate a t.05-acre park and the balance of <br />Park Dedication will consist of a caslx payment of $35,700 dollars. The payment of this fee will <br />be required prior to recording the plat. The final plat slaould be revised dedicating Outlot A has a <br />park instead of an outlot. <br /> <br />Park Trail Development Fee: The City has enacted a trail development fee. The current rate is <br />$400.00 per lot. The payment of this fee will be required prior to recording the plat. An eight <br />foot bituminous pedestrian trail will be constructed along the southern boundary line west of <br />Cobalt Street. The construction costs will be an eligible credit towards trail fees due on the plat. <br /> <br />The trail may be located within the 20-foot drainage and utility easement that may be located on <br />the subject property for watermain looping purposes. The developer will be required to provide <br />the City with an easement for trail purposes along the south boundary of the property from the <br />west edge of Cobalt Street to the west plat boundary. <br /> <br /> <br />
