The DEVELOPER herein agrees to provide the CITY with a <br />separate document, in recordable form, granting the CITY an easement for trail purposes <br />along the south boundary of the property from the west edge of Cobalt Street to the west <br />plat boundary. The DEVELOPER also agrees to construct an eight-foot wide <br />bituminous trail within the trail easement, consistent with the Final Construction Plan <br />prepared by James R. Hill, dated February 26, 2002. The actual construction cost shall be <br />considered as an eligible credit towards the Trail Fee's due on the plat. <br /> <br />Trail Development Fees. The City's Trail Development Fee is in the amount of Four <br />Hundred Dollars and no cents ($400.00) per unit. Therefore, a payment in the amount of <br />Thirty Three Thousand Six Hundred Dollars and no cents ($33,600.00) (84 lots x <br />$400.00/lo0 is due to the City prior to releasing the Final Plat for recording. The amount <br />due shall be reduced in an amount equal to the actual construction costs for the <br />construction oft he trail described in item #20 of this agreement. <br /> <br />Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance <br />with CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in <br />locations prescribed by the CITY, not to exceed 5% in grade, along the east side of <br />Cobalt Street NW within the boundaries of the Plat. This sidewalk construction is not <br />Trail Development Fee or Park Dedication credit eligible. <br /> <br />SECTION VI <br />LANDSCAPING <br /> <br />Tree, Shrub and Sod Planting Plan. The DEVELOPER herein agrees to install trees, <br />shrubs, and ground cover consisting of sod in accordance with the Final Construction <br />Plan prepared by James R. Hill dated February 26, 2002. <br /> <br />Tree Disease Prevention and Disposal. The DEVELOPER shall prevent the <br />introduction and spread of tree disease into the residual tree populations of the Plat and <br />adjoining properties and reduce the impacts of construction on the residual property of <br />the Plat and adjoining properties. The DEVELOPER, in order to protecting trees from <br />construction damage shall: <br /> <br />a) Install physical barriers, such as snow fence, around trees that are to remain. The <br /> fencing shall be located at the dripline of these remaining trees. <br /> <br />b) <br /> <br />Insure that all equipment operators will have readily available, a tree wound dressing <br />and will apply it immediately to damaged oak trees if wounding occurs from April <br />15 through July 15. <br /> <br />c) <br /> <br />Insure that trees will only be skidded against other trees that are.to be removed. <br />Trees in the middle twenty (20) feet of a road easement will be removed first, with <br />remaining trees to be skidded toward the middle of the road easement.
