I <br /> I <br /> I <br /> I <br /> I <br /> I <br />,I <br /> I <br /> <br />I <br />! <br /> <br />CASE # <br /> <br /> ADOPT RESOLUTION TO AMEND " <br />RIVER PINES 4TM ADDITION DEVELOPMENT AGREEMENT <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />On May 19, 1998. The City granted final plat approval of River Pines 4th Addition. Part ofttxe <br />development agreement required that the intersection of 158th Avenue N.W. and Potassium St. <br />N.W. be gated to restrict through traffic to emergency vehicles only. in addition, the Developer <br />was required to deposit $1,500.00 with the City to defray the costs associated with gating the <br />intersection. <br /> <br />On November 1, 2001, the Developer (Orrin Thompson Homes) issued a letter to the City of <br />Ramsey requesting that the requirement to gate the intersection of 158th Avenue and Potassium <br />St. N.W. be waived. The basis for the request was the feeling that the restricted intersection <br />would be a traffic hazard, impede emergency services, and serve to divide the neighborhood. <br /> <br />On February 19, 2002, the City Council Public Works Committee met and considered the request <br />to eliminate the requirement to restrict the intersection of 158th Avenue N.W. and Potassium St. <br />N.W. A motion was passed to recommend that City Council eliminate the requirement for a <br />gated intersection. <br /> <br />On March 12, 2002, the City Council ratified the recommendation of the Public Works <br />Committee on February 19, 2002. <br /> <br />Observations: <br /> <br />The City Attorney has advised that the decision to eliminate the gating requirement in River <br />Pines 4t~ Addition is an amendment to the development agreement and should be affirmed by <br />resolution. The proposed resolution is enclosed. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the enclosed resolution and refunding the $1,.500.00 collected <br />from the Developer to defray the cost of installing a gate at the intersection of 158th and <br />Potassium. <br /> <br />Council Action: <br />Motion to adopt Resolution #02-04-D~amending the River Pines 4th Addition Development <br />Agreement to eliminate the requirement for the installation of a gate at the intersection of 158th <br />Avenue N.W. and Potassium St. N.W., and to authorize the Finance Department to refund the <br />deposit collected from the Developer for said installation costs. <br /> <br />Review Checklist: <br />Public Works Director/Fire Chief <br />City Attorney <br />Finance Officer <br />Principal City Engineer <br /> <br />CC: 04/09/02 <br /> <br />-189- <br /> <br /> <br />
