Councilmember introduced the following resolution and moved for its adoption: · <br /> <br />-190- <br /> <br />RESOLUTION #02-04- <br /> <br />RESOLUTION TO AMEND THE DEVELOPMENT AGREEMENT FOR RIVER PINES <br />4TM ADDITION <br /> <br /> WHEREAS, on May 12, 1998, the City of Ramsey granted final plat approval to River <br />Pines 4th Addition and entered into a development agreement with the U.S. Home Corporation <br />(aka Orrin Thompson Homes)(the "Developer"); and <br /> <br /> WHEREAS, the development agreement for River Pines 4th Addition established that the <br />intersection of 158th Avenue N.W. and Potassium Street N.W. would be restricted as a through <br />street for emergency vehicles on!y; that the City would be installing a gate at the intersection of <br />158~h Avenue N.W. and Potassium Street N.W.; and that the Developer shall make a deposit at <br />the City in the mount of $1,500.00 to defray the City's expenses associated with the installation <br />of the gate; and <br /> <br /> WHEREAS, on the City received a letter from On-in Thompson Homes dated November <br />1, 2002, requesting that the City reconsider the requirement for a gated intersection based on the <br />opinion that it would be a traffic hazard, impede emergency services, and serve to divide the <br />neighborhood; and <br /> <br /> WHEREAS, the Ramsey City Council Public Works Committee met on February 19, <br />2002, to consider the Developer's request for an amendment to the development agreement for <br />River Pines 4th Addition and following a discussion with members of the Public Works <br />Department, recommended that City Council grant the request; and <br /> <br /> WHEREAS, during the February 19, 2002, Public Works Committee meeting, the <br />Director of Public Works/Fire Chief and Street Supervisor supported the Developer's request <br />from a maintenance aspect; and <br /> <br /> WHEREAS, on March 12, 2002, the City Council ratified the February 19 2002, <br />recommendation of the Public Works Committee and <br /> <br /> WHEREAS, the City Attorney has advised that the City Council action of February 19, <br />2002, should be affirmed by resolution. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />t) <br /> <br />That the Ramsey City Council hereby amends the Development Agreement for River <br />Pines 4'~' Addition to eliminate Item #5 requiring the intersection of 158ta Avenue N.W. <br />and Potassium St. N.W. to be gated and restricted for use by emergency vehicles only. <br /> <br /> <br />
