Councilmember introduced the following resolution and moved for its adoption: · -190- RESOLUTION #02-04- RESOLUTION TO AMEND THE DEVELOPMENT AGREEMENT FOR RIVER PINES 4TM ADDITION WHEREAS, on May 12, 1998, the City of Ramsey granted final plat approval to River Pines 4th Addition and entered into a development agreement with the U.S. Home Corporation (aka Orrin Thompson Homes)(the "Developer"); and WHEREAS, the development agreement for River Pines 4th Addition established that the intersection of 158th Avenue N.W. and Potassium Street N.W. would be restricted as a through street for emergency vehicles on!y; that the City would be installing a gate at the intersection of 158~h Avenue N.W. and Potassium Street N.W.; and that the Developer shall make a deposit at the City in the mount of $1,500.00 to defray the City's expenses associated with the installation of the gate; and WHEREAS, on the City received a letter from On-in Thompson Homes dated November 1, 2002, requesting that the City reconsider the requirement for a gated intersection based on the opinion that it would be a traffic hazard, impede emergency services, and serve to divide the neighborhood; and WHEREAS, the Ramsey City Council Public Works Committee met on February 19, 2002, to consider the Developer's request for an amendment to the development agreement for River Pines 4th Addition and following a discussion with members of the Public Works Department, recommended that City Council grant the request; and WHEREAS, during the February 19, 2002, Public Works Committee meeting, the Director of Public Works/Fire Chief and Street Supervisor supported the Developer's request from a maintenance aspect; and WHEREAS, on March 12, 2002, the City Council ratified the February 19 2002, recommendation of the Public Works Committee and WHEREAS, the City Attorney has advised that the City Council action of February 19, 2002, should be affirmed by resolution. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: t) That the Ramsey City Council hereby amends the Development Agreement for River Pines 4'~' Addition to eliminate Item #5 requiring the intersection of 158ta Avenue N.W. and Potassium St. N.W. to be gated and restricted for use by emergency vehicles only.
