I <br />I <br />I <br />I <br />I <br /> <br />Councilmember Hendriksen inquired if there is sufficient language that would say that #12 <br />would not be developed in advance of the town center. <br /> <br />Principal Planner Trudgeon reviewed the language pertaining to the tiering phases. <br /> <br />Councihnember Kurak inquired if the phasing is a moratorium on the property. <br /> <br />City Attorney Goodrich replied no, noting that the language would take some interpretation. He <br />stated that the wording "significant amount" he would assume that would be over 50 percent, but <br />someone could argue a different number. Those are the troublesome words that are problematic. <br />He stated that they need to give specifics to be more definable. <br /> <br />Councilmember Hendriksen inquired if there needs to be something more specific in the <br />Comprehensive Plan. <br /> <br />City Attorney Goodrich replied that the Comprehensive Plan is not intended to be precise. <br /> <br />Councilmember Kurak inquired if they were not imposing some type of moratorium by <br />implementing the phasing requirement. <br /> <br />City Attorney Goodrich replied no, explaining that it is a guide, not an absolute. The City should <br />have the ability to interpret its own Comprehensive Plan. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Anderson, to adopt Resolution #02-02~ <br />__ approving an amendment to the Comprehensive Plan to change the land use from Places to <br />Work to Mixed Use, and attthorizing staff to submit the Comprehensive Plan amendment to the <br />Met Council. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Kurak and <br />Zimmerman. Voting No: Councilmember Hendriksen. <br /> <br />Peltzer Addition <br /> <br />Principal Planner Trudgeon stated that the City received a request to expand the MUSA to <br />include Lots 1 and 2, Block 6 of Peltzer Addition. The Planning Commission approved the <br />change unanimously. <br /> <br />Jeff Stafeld, 6890 148'~' Lane NW, Ramsey, stated that the person who is looking to develop the <br />land has already started doing improvements to the existing home. He stated that he did not <br />receive any notice on the proposed land use change and all if the neighbors are against what the <br />landowner wishes to do which is subdivide the land and develop another home as well as provide <br />access to both places on 148°' Lane. <br /> <br />City Council/February 26, 2002 <br /> Page 23 of 35 <br /> <br />-4-/- <br /> <br /> <br />
