-54-

Case/410: Introduce Ordinance Vacating Certain City Streets

City Engineer Janko~vski stated that a review of the City street system resulted in the
identification of three dedicated segments of fight-of-way, which appeared to have no reasonable
public purpose for roadway. Two of the segments were undeveloped as roadxvay. The third
parcel, a segment of Juniper Ridge Drive was presently paved. It was proposed that the existing
pavement would be removed and restored by placing topsoil, seed and mulch. A public hearing
was held on the proposed vacations on October 23, 2001 and no comments were offered.

Motion by Councilmember Hendriksen, seconded by Councihnember Kurak, to introduce
Ordinance #02-02- vacating certain City streets.

Motion can'ied. The City entered into negotiations for
the sale of the southern parcel to Northern Airgas in 1998. During the negotiations with
Northern Airgas, it was determined that 70 feet of Lot 1, Block 1, in Business Park 95 Second
Addition would not be required for the sale to Northern Airgas. Peck Properties had indicated
interest in acquiring the 70 feet of property to have included on to his property. Mark Peck
agreed to pay $1.50 per square foot, which brought the total purchase price to $39,060. The
negotiations were completed in 1998, however, the deed was never recorded and the City did not
receive the payment for the 70 feet of property. Mark Peck recently contacted the City
requesting to complete the sale of land for the property he has interest in acquiring. The case
presented to the Council would introduce the sale ordinance committing the sale of that 26,040
square feet tract of land the City owns to Peck Properties, LLC, a Minnesota Limited Liability
Company. The purchase price of the land would be $39,060. Anoka County has assigned the
value to the property of $9,700, according to the Assessor's office.

Motion by Councilmember Hendfiksen, seconded by Councilmember Kurak, to introduce
Ordinance #02-02- permitting the sale of a 26,040 square foot tract of City owned land to
Peck Properties, LLC, a Minnesota Limited Liability Company.
