City Attorney Goodrich replied that the <br />City has received the appraisal of the property and they are willing to provide the City early <br />access if the City deposits the approved appraisal value of $52,300. Councilmember <br />Zimmen-nan noted that he has seen that the contractor's equipment is already on the site. City <br />Engineer Olson stated that he received a call from the subcontractor inquiring if they could move <br />the equipment in early because of the weight restrictions and Mr. Olson and told them that they <br />could place it on the property at their own risk. <br /> <br />Motion was amended to be subject to the City Attorney confirming that right of access has been <br />obtained. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Kurak, Anderson, <br />Hendriksen, and ZimmmTnan. Voting No: None. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to adopt Resolution <br />#02-02- approving appraisal of damages for the acquisition of the parcels owned by the <br />MPCA necessary for the construction of the extension of Sunwood Drive and Azurite Streets. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Hendriksen, Kurak, <br />Anderson, and Zimmerman. Voting No: None. <br /> <br />Case #9: Consider Introduction of a No Trespassing Ordinance <br /> <br />City Attorney Goodrich stated that last summer, the Ramsey Police Department ticketed four <br />juveniles, who were sitting on the landfill watching fireworks. The Anoka County Attorney's <br />office refused to proceed with prosecution because state statutes do not prohibit such conduct. <br />Simply walking on a property that has a "no trespassing" sign or a fenced in area is not an <br />offense under state statute. If a person is asked to leave and refuses to leave, or is asked to leave <br />and then returns, the person can be cited for trespassing under state statutes. The County <br />Attorney's office suggested that the City adopt a no trespassing ordinance similar to the Coon <br />Rapids no trespassing ordinance, in order to prosecute for such violations. Staff recommended <br />that the Council consider a no trespassing ordinance in the interest of cooperating with the <br />MPCA in its management of the closed Anoka Regional Landfill. On August 14, 2001, the City <br />Council directed staff to draft the no trespassing ordinance and to present it for introduction. <br /> <br />Motion by Councilmember Hendfiksen, seconded by Councilmember Kurak, to introduce <br />Ordinance #02-02- adding Section 5.16 to the City Code and which Section provides for <br />prosecution and penalties for persons trespassing certain properties within the City. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, Anderson, <br />and Zimmerman.
