-182- ("Required Improvements). FIRE LANES. Fire lanes shall be maintained on the Site. The exact location of these items on the Site shall be as directed by the City's Fire Chief. 7. LIGHTING. Any lighting installed on the Site is subject to prior approval by the City Engineer. BUILDING FACADE. The Perrnittee agrees to construct the Structures of maintenance- tree siding, masonry brick, and asphalt shingles in accordance with the Building Elevations dated November 28,200 l, prepared by ESG Architects, Inc. 9. MAILBOX STANDARDS. A uniform cluster mailbox plan will be required. The design and location of the mailboxes are subject to the'approval of the Public Works Director. 10. REQUIREMENTS FOR BUILDING PERMIT. No building permit shall be issued until: (a) the plat of Sunwood Estates has been recorded at Anoka County; (b) a Class 5 driving surface is installed to within 300 feet of the structure; (c) a Certificate of Survey, including that survey information required by the CITY has been supplied to the City Building Official; and (d) all the financial guarantees required by the CITY have been satisfied; and (e) the CITY has been provided with a copy of all permits required by other agencies. Approval of the building foundation requires a certificate of elevation signed by a licensed (Sta~;e of Minnesota), professional land surveyor, verifying that the elevation complies with the approved grading plan for the Plat. Foundation approvals will require a certificate of elevation verifying that the actual elevation is in compliance with the approved grading and drainage plan.. The lowest floor elevation shall be at least 2 feet above the 100 year elevation. No occupancy permits shall be issued until: (a) vehicular access is provided including the installation of at [east one layer of bituminous surfacing; (b) all utilities .are in place, operational and accepted by the CITY; (c) the City has been provided with a certificate of grading for any lot with a slope flatter than 2%. 11. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall be completed before November 1, 2002. 12. ESCROW FOR REQUIRED IMPROVEMENTS. The DEVELOPER has provided financial surety for improvements as a part of the Development Agreement associated with the Sunwood Estates Plat. The DEVELOPER agrees that this escrow.will apply to all improvements referenced herein. Upon completion of the construction of the Required Improvements, the financial guarantee shall be returned to the Permittee and the Permittee shall be required to provide the landscaping maintenance guarantee described in Item #13 of this Development Permit. The determination of completion of the construction of the Required Improvements shall be made by the City Council after consultation with the City Engineer.
