I <br />I <br />I <br /> <br /> I <br /> I <br /> I <br />,I <br /> I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> i <br /> I <br /> I <br /> I <br /> I <br /> <br /> SUNWOOD ESTATES <br /> DEVELOPMENT AGREEMENT <br />CITY OF RAMSEY, ANOKA COUNTY, MINNESOTA <br /> <br /> THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, <br />a municipal corporation under the laws of the State of Minnesota (the "CITY"), and ACCAP - <br />RAMSEY TOWNHOMES, a limited partnership, whose address is 1.201 89~h Avenue, #345, <br />Blaine, MN 55434 ("DEVELOPER"). <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the DEVELOPER is the fee owner of the following described property <br />situated in the CITY OF R/uMSEY, County of Anoka, State of Minnesota, and legally described <br />as fbtlows: <br /> <br />That part of the East Half of the Northwest Quarter of Section 25, Township 32, Range <br />25, Anoka County, Minnesota, lying westerly of the centerline of State Trunk Highway <br />No. 47 and northerly of"Line A" and its extensions described as follows: <br /> <br />Commencing at a point on the centerline of above said State highway No. 47 distant <br />1083.00 feet north of the south line of said East Half of the Northwest Quarter as <br />measured along said centerline; thence westerly parallel with said south line of the East <br />Haft of the Northwest Quarter to the intersection with the west line of said East Half of <br />the Northwest Quarter; thence northerly along said west line a distance of 757.00 feet to <br />the actual point of beginning of said "Line A'" thence easterly parallet with the south line <br />of said East half of the Northwest Quarter to the centerline of said State Highway No. 47 <br />and said line there terminating. <br /> <br />- or upon recording - <br /> <br />Lot 1, Block 1, and Outlot A, SUNWOOD ESTATES, Anoka County, Minnesota. <br /> <br />(the "Plat"); and <br /> <br /> WHEREAS, on March 26, 2002, pursuant to Resolution No. 02-03- , the CITY <br />approved the final plat of the Subject Property which plat is known as SUNWOOD ESTATES <br />(the "Plat"), which approval is contingent on certain requirements, including the DEVELOPER <br />and the CITY entering into this Agreement; and <br /> <br /> WHEREAS, the final plat for the Subject Property conforms to the sketch plan for <br />Sunwood Estates approved by the Planning Commission on February 7, 2002; and <br /> <br /> WHEREAS, a trunk usage charge is required by the CITY for usage of its Trunk Sewer <br />and Watermain System, which charge is $1,814.00 per residential' unit created; and <br /> <br /> WHEREAS, the CITY requires certain improvements to be constructed within the Plat, <br />which improvements are defined as Stage [ and Stage [I Improvements in the City Code; and <br /> <br />-193- <br /> <br /> <br />
