-92- It should be noted that the Minnesota Department of Transportation has initiated a TH 10 Interregional Corridor Management Plan for State Highway #10. The City Council adopted a resolution on January 8, 2002 stating the City's support for the TH 10 Interregional Corridor Management Plan to convert TH I0 to a freeway system. An exact alignment has not been determined, however MnDot has stated initial support for a freeway alignment that is located adjacent to the BNSF railroad tracks. The subject property could be affected by the future conversion of State Highway #I0 to a freeway. Staff is unable to determine how the subject property will be affected at this time due to the uncertainty, of the exact alignment of the freeway and the timeline for the State Highway #10 project. Staff does not feel that the condition of the customer/employee parking area and other traveled portions of the site are in compliance with City Code. The pavement is in a significantly deteriorated condition. Staff is recommending that the Permittee or his designee install 1 ½ inch bituminous overlay on the existing customer/employee parking lot. Recommendation: The Planning Commission recommended approval contingent upon the traveled areas of the sitex~ being upgraded with an overlay of pavement. Motion to adopt Resolution # dopting Findings of Fact #X.~ relating to the request for a conditional use permit. - Motion to adopt Resolution r for a condition~t..use, permit based on Findings of Fact # and declaring terms of the conditional use permit. -or- Motion to deny the request for a conditional use permit based on the findings of fact.
