• What about parcels that only partially adjoin open space, should they be subject to the standard
or reduced setback?
Finally, Staff would also recommend that the Planning Commission consider whether the reduced setback
should only apply to properties within the MUSA area of the R -1 Residential zoning district. If the main
intent of the rear yard setback is to ensure some separation between living spaces on adjoining parcels,
then, regardless of lot size, might it make sense to allow a reduced rear yard setback in the other areas of
the R -1 Residential zoning district that meet the same criteria? The draft ordinance is specific to the
MUSA area only.
Commission Action:
Motion to recommend that the City Council introduce an ordinance amending Chapter 117 -111 of the
City's Zoning Code to include a reduced rear yard setback on properties adjoining permanent open space
areas.
Review Checklist:
Associate Planning
Planning Manager
PC: 1/6/11
Attachments:
A) Draft Board of Adjustment meeting minutes dated December 2, 2010
B) Proposed ordinance with revisions
