P12 <br />Councilmember Elvig stated the four- wheeler was not an issue and neither was the lawnmower <br />parking in the yard while the applicant worked on it. He recommended tabling this one more <br />time to allow staff and the applicant to work on this further. <br />Associate Planner Gladhill noted the Council also had the ability to approve an alternative <br />request with a review in six months. <br />Councilmember Jeffrey noted if there were not concessions made, he would not approve this <br />request. He acknowledged putting the trailer in the garage at night was an inconvenience, but it <br />was necessity. <br />Councilmember McGlone stated carpooling was unreliable. He did not believe things were <br />going to change. He did not believe this was only a summer business and it was a business that <br />did not belong in a residential area. <br />Motion by Councilmember McGlone, seconded by Councilmember Elvig, to Adopt Resolution <br />#10 -10 -248 adopting Findings of Fact #0880 in the negative and deny the request for a home <br />occupation permit, with change to Findings of Fact 29 as stated. <br />Further discussion: Councilmember Elvig offered to deny the permit with a stay of the denial for <br />six months with conditions and if the conditions can be met on a regular basis without further <br />complaint that the applicant can come back for approval. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Dehen, Elvig, Jeffrey, McGlone, <br />and Wise. Voting No: None. Absent: Councilmember Look. <br />Motion by Councilmember McGlone, seconded by Councilmember Dehen, to deny the <br />application based on the Findings of Fact. <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to amended the motion <br />to state: Motion to deny staying for a six months period of time to allow applicant to come into <br />compliance, if he can, after which time the applicant can reapply for a home permit. <br />Further Discussion: Councilmember Wise expressed concern that this was setting a precedent. <br />He noted this was too small of a lot and the City did not have the ability to monitor this <br />Amended Motion failed. Voting Yes: Councilmembers Jeffrey and Elvig. Voting No: Mayor <br />Ramsey, Councilmembers Dehen, McGlone, and Wise. Absent: Councihnember Look. <br />Motion carried. Voting Yes: Mayor Ramsey, Councilmembers Dehen, Elvig, McGlone, and <br />Wise. Voting No Councilmember Jeffrey.
