I <br /> I <br />I <br /> I <br /> I <br /> I <br />I <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />I <br />I <br /> <br />Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #02-03- <br /> <br />A RESOLUTION DENYING AN AMENDMENT TO THE COMPREHENISIVE PLAN <br /> <br /> WHEREAS, on November 26, 2001, the City of Ramsey received a written request for <br />an amendment to the Comprehensive Plan from Thomas Kurak (the Applicant) for the purpose <br />of amending the land use designation of the property shown on Attachment A (the Subject <br />Property); and <br /> <br /> WHEREAS, on January 14, 2002, the City notified the Applicant in writing that it was <br />extending the time permitted to act, pursuant to Minn. Statute 15.99, for an additional 60 days, <br />thereby extending the City's last date to act on the application to March 26, 2002; and <br /> <br /> WHEREAS, the 2001 Comprehensive Plan shows the Subject Property's designated <br />land use as Low and Medium Density Urban Residential; and <br /> <br /> WHEREAS, the Applicant is requesting that the Subject Property's designated land use <br />be changed to Mixed Use; and <br /> <br /> WHEREAS, the Ramsey Planning Commission and City Council conducted a public <br />hearing on January 24, 2002 in order to take testimony regarding the proposed land use change; <br />and <br /> <br /> WHEREAS, the Ramsey Planning Commission met on February 7, 2002 and <br />recommended that the Ramsey City Council approve the request for an amendment to the <br />Comprehensive Plan; and <br /> <br /> WHEREAS, the Mixed Use section of the Rarnsey Comprehensive Plan, as presently <br />drafted, does not state the maximum allowable density of residential units per acre; and <br /> <br /> WHEREAS, the area to the north of the Subject Property is comprised of large-lot rural <br />residential lots; .and <br /> <br /> WHEREAS, as of the date hereof, the City has not established a maximum amount of <br />density for residential development which can take place within a Mixed Use guided area and <br />this creates a potential conflict of uses between the existing low density neighborhood to the <br />north of the Subject Property and any new development which would be permitted if the Subject <br />Property were guided for mixed use, and; <br /> <br /> WHEREAS, the City approved a Comprehensive Plan on December 18, 2001, that <br />designated the Subject Property as being Iow and medium density urban residential and that was <br />a culmination of five years of dialogue between the community and City Council; and <br /> <br />-215- <br /> <br /> <br />
