-64- <br /> <br />Chairperson Nixt replied that what Councilmember Hendriksen was suggesting is that they <br />would be subject to reviewing every page of the document during every public hearing. <br /> <br />Councilmember Hendriksen inquired if Chairperson Nixt felt that if a resident wanted something <br />changed they would have to cQnvince staff to bring it forward. <br /> <br />Chairperson Nixt replied no, but explained that there are appropriate ways to do that. He <br />inquired if Mr. Menth was opposed to adding the language pertaining to the City Charter. <br /> <br />Mr. Menth stated that his concern is that a majority of the people in the central planning area <br />don't know that the City has plans to connect them to City sewer and water. What he wanted to <br />know is what the additional language meant. <br /> <br />Commissioner Johnson stated that they have discussing the issue for some time and felt that it <br />was apparent that the language is not clear and should be clarified. <br /> <br />Principal Planner Trudgeon stated that the proposed language would refer to a document that is <br />an official part of the Comprehensive Plan, which is a Charter Amendment that states that <br />residents will not be forced to hook-up to City sewer and water. He reviewed the language in <br />that Charter Amendment. <br /> <br />Mr. Menth inquired if they were stating that the City cannot force him to connect to City sewer <br />and water and they don't have to pay for the extension of services. <br /> <br />Principal Planner Trudgeon replied that was correct, noting that they would not have to pay for <br />the services until they decide to hook-up. <br /> <br />Mr. Krueger noted that when they extended sewer by his property he was not required to hook-up <br />and still is not required to do so until the system fails or the property is sold. <br /> <br />Councilmember Hendriksen stated that the question is can State law or State regulations Preempt <br />the City Charter. <br /> <br />Ms. Hunter stated that there are no absolute guarantees in the world. Progression needs to <br />happen and they need to have a vision to make the world work. People cannot expect that things <br />will never change. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Sweet, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Sweet, Brauer, and <br />Watson.
