She expressed concern that they <br />were moving to soon on many of the issues until the questions pertaining to the highway are <br />answered. She questioned if they state in the Comprehensive Plan how much of the land in a <br />mixed use development can be used for residential and how much can be used for commercial <br />would that hold up in court. <br /> <br />Chairperson Nixt replied that the concept would be that there would be a zoning overlay district, <br />but would have to get a legal opinion regarding Ms. Cormolly's question. <br /> <br />Ms. Connolly requested that a legal opinion be given at the next meeting. <br /> <br />Mr. Menth inquired as to what was changing with the Central Rural Preserve language. <br /> <br />Chairperson Nixt explained that language .w_as being added to referencing the fact that .they are a <br />Charter City. <br /> <br />Councilmember Hendriksen stated that he had requested that language be included that the City <br />would not require people to hook-up to City services if it were extended in front of their home <br />because he wanted to the Met Council to read that language and agree to it. His concern was that <br />they will find out that the Met Council supercedes the City Charter. <br /> <br />Chairperson Nixt stated that the purpose of adding the language pertaining to the City Charter <br />was to protect those people in the rural areas from having to connect to City sewer and water. <br /> <br />Mr. Menth inquired if it would protect the people in the central rural preserve area. <br /> <br />Chairperson Nixt replied that it would apply to all homeowners equally in the City of Ramsey. <br /> <br />Mr. Menth stated that he felt that the purpose of the central rural preserve area was to bring City <br />sewer and water through the area and that by 2020 they will have to hook up. <br /> <br />Chairperson Nixt explained that the central rural preserve area language has already been <br />adopted as part of the Comprehensive Plan, that additional language regarding the City Charter <br />would be added as an amendment. The language that is included in the plan states that the City <br />will work to identify the potential for urban services after 2020, it does not state that residents <br />will be required to connect by 2020. <br /> <br />Councilmember Hendriksen stated that he objected to the way the discussions were being <br />limited. The reason the meeting was being held was to decide how they want to change the <br />Comprehensive Plan and he did not feel that they should limit discussion to only those suggested <br />changes that have come from staff, Council or the Planning Commission.
