FIRE LANES. Fire lanes shall be maintained on the Ske. The exact location of these items on the Site shall be as directed by the City's Fire Chief. LIGHTING. Any lighting installed on the structure or in the parking lot is subject to the prior approval of the City Engineer and shall be designed so as to deflect light away from all adjacent parcels. Bulbs emitting in excess of 3,000 lumens (150 watts) shall be so directed that the bulb is not visible from off of the property where such light source is located BUILDING FACADE.. The Permittee agrees to face the Structure with rock face concrete block, in accordance with the Exterior Elevations prepared by WCL Associates Inc dated January 14, 2002. REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF OCCUPANCY. No building permit for the Site will be issued until the permittee has: a) signed and returned this Development Permit; b) provided the required cash payment for stormwater management in accordance with Item #6 of this Permit; c) provided the required financial guarantee in accordance with Item #12 of this Permit; d) provided the City with a copy of the Grading and Drainage Permit issued by the Lower Rum River Water Management Organization; and e) the final plat for West Ramsey Industrial Park has been recorded at Anoka County. No Certificate of Occupancy for the structure will be issued until: a) the Required Improvements are accepted by the City; and b) the landscaping maintenance guarantee has been provided in accordance with Item #13 of this Development Permit. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall be completed before March 1, 2003. ESCROW FOR REQUIRED IMPROVEMENTS. In order to ensure the installation of the Required Improvements in accordance with City specifications and in a timely manner, the Permit-tee shall be required to deposit with the City a cash escrow or letter of credit, approved as to form by the City, in the amount of $56,200; which is 150% of the City's estimated cost of the Improvements. Prior to the issuance of the building permit, all financial guarantees must be provided as required herein. Upon completion of the construction of the Required Improvements, the financial guarantee shall be returned to the Permittee and the Permittee shall be required to provide the landscaping maintenance guarantee described in Item #13 of this Development Permit. The determination of completion of the construction of the Required Improvements shall be made by the City Council after consultation with the City Engineer. In the event the Permittee fails to construct and install the Required Improvements as required herein, the City Council may order the completion of the -173-
