10. <br /> <br />11. <br /> <br />12. <br /> <br />the Site is seventeen thousand one hundred thirty four dollars ($17,134.00) (4.58 acres x <br />$3741/acre). A cash payment will be required prior to the CITY releasing the Building <br />Permit. <br /> <br />FIRE LANES. Fire lanes shall be maintained on the Ske. The exact location of these <br />items on the Site shall be as directed by the City's Fire Chief. <br /> <br />LIGHTING. Any lighting installed on the structure or in the parking lot is subject to the <br />prior approval of the City Engineer and shall be designed so as to deflect light away from <br />all adjacent parcels. Bulbs emitting in excess of 3,000 lumens (150 watts) shall be so <br />directed that the bulb is not visible from off of the property where such light source is <br />located <br /> <br />BUILDING FACADE.. The Permittee agrees to face the Structure with rock face <br />concrete block, in accordance with the Exterior Elevations prepared by WCL Associates <br />Inc dated January 14, 2002. <br /> <br />REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF <br />OCCUPANCY. No building permit for the Site will be issued until the permittee has: a) <br />signed and returned this Development Permit; b) provided the required cash payment for <br />stormwater management in accordance with Item #6 of this Permit; c) provided the <br />required financial guarantee in accordance with Item #12 of this Permit; d) provided the <br />City with a copy of the Grading and Drainage Permit issued by the Lower Rum River <br />Water Management Organization; and e) the final plat for West Ramsey Industrial Park <br />has been recorded at Anoka County. <br /> <br />No Certificate of Occupancy for the structure will be issued until: a) the Required <br />Improvements are accepted by the City; and b) the landscaping maintenance guarantee <br />has been provided in accordance with Item #13 of this Development Permit. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements <br />shall be completed before March 1, 2003. <br /> <br />ESCROW FOR REQUIRED IMPROVEMENTS. In order to ensure the installation <br />of the Required Improvements in accordance with City specifications and in a timely <br />manner, the Permit-tee shall be required to deposit with the City a cash escrow or letter of <br />credit, approved as to form by the City, in the amount of $56,200; which is 150% of the <br />City's estimated cost of the Improvements. Prior to the issuance of the building permit, <br />all financial guarantees must be provided as required herein. <br /> <br />Upon completion of the construction of the Required Improvements, the financial <br />guarantee shall be returned to the Permittee and the Permittee shall be required to provide <br />the landscaping maintenance guarantee described in Item #13 of this Development <br />Permit. The determination of completion of the construction of the Required <br />Improvements shall be made by the City Council after consultation with the City <br />Engineer. In the event the Permittee fails to construct and install the Required <br />Improvements as required herein, the City Council may order the completion of the <br /> <br />-173- <br /> <br /> <br />
