I <br />I <br /> ! <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br /> I <br /> I <br /> I <br />,I <br /> I <br /> I <br /> I <br /> <br />The Northeast quarter of the Southeast quarter of Section 26, Township 32, Range <br />25, Anoka County, Minnesota. <br /> <br />(the '.'Subject Property") <br /> <br /> WHEREAS, on May 15, 200I the City received an application for a preliminary plat <br />known as The Ponds (the "Development"); and <br /> <br /> WHEREAS, on June 5, 2001, the Planning Commission held a public hearing regarding. <br />the preliminary plat pursuant to City Ordinances and Minnesota State Statutes and recommended <br />approval of the preliminary plat subject to conditions; and <br /> <br /> WHEREAS, on June 26, 2001, the City Council 'considered the preliminary plat for the <br />Development; and <br /> <br /> WHEREAS, on June 26, 2001, the City Council tabled' the preliminary plat request alSer <br />the Developer withdrew a rezoning application that was needed in order to properly plat the <br />Development; and <br /> <br /> WHEREAS, on July 2, 2001 the City received correspondence from the State of <br />Minnesota Environmental Quality Board (the "EQB") stating that it had received a citizen petition <br />requesting that an Environmental Assessment Worksheet (the "EAW") be completed for the <br />Development; and <br /> <br /> WIREREAS, on July 30, 2001, City staffsent the EQB a letter stating that the Developer <br />had withdrawn its rezoning application that was needed in order to properly plat the Development <br />and that the City Council was unable to proceed in the review process with the Development; and <br /> <br /> WIREREAS, the July 30, 2001 letter to the EQB stated that if the applicant reapplies to <br />subdivide the Subject Property within one year of receiving the citizen petition, the City would <br />make a decision on the citizen petition; and <br /> <br /> WHEREAS, on December I4, 2001, the City received an application for a prelim/nary <br />plat approval from the Developer; and <br /> <br /> WltEREAS, on January 3, 2002, the Planning Commission held a public hearing and <br />reviewed the preliminary plat and recommended approval of the preliminary plat subject to certain <br />conditions; and <br /> <br /> WltEREAS, the City hired Pro Source Technologies, Inc. to review the citizen petition <br />and make a determination On the issues presented in the petition; and <br /> <br /> WHEREAS, in correspondence dated August 3, 2001, Pro Source Technologies, Inc.' <br />determined that the Development will not have a significant environmental effect and that the <br /> <br />RESOLUTION #02-02- <br /> Page 2 of 3 <br /> <br />-223- <br /> <br /> <br />
