-252- <br /> <br />The plat is retaining a 66-foot drainage and utility easement through the plat in an east/west <br />direction. The easement is intended to preserve a corridor for a future road that is designated in- <br />the comprehensive plan to facilitate the future extension of 167m Avenue to Armstrong Blvd. <br /> <br />At their September 10, 2001 meeting, the Planning Commission reviewed the proposed <br />subdivision and recommended that the applicant proceed to final plat stage. <br /> <br />During the Staff review of the final plat of McDonald 2~d Addition, the applicant was notified <br />that the City has an unwritten policy that requires all wetlands to be encumbered by a drainage <br />and utility easement. Mr. McDonald made the decision not to continue with the proposed plat at <br />that time. <br /> <br />The City Council reviewed Mr. McDonalds request to withdraw his application for final plat <br />approval on October 9, 2001. During the meeting the City Council directed staff to review the <br />current policy regarding encumbering wetlands and provide alternatives, bar. McDonald <br />rescinded his request-to withdraw his application and waived the 60 day decision rUle to allow <br />time for the City Council and City Staff to review the current policy and possibly look at other <br />alternatives. <br /> <br />The City Council adopted a policy on January 22, 2002 stating that parcels outside of the MUSA <br />Boundary that are ten acres in size or larger may be exempt from dedicating a drainage and <br />utility easement over the wetlands located on a subject parcel. <br /> <br />The City Engineer has reviewed the proposed McDonald 2na Addition final plat. It would appear <br />that the proposed McDonald 2nd' Addition meets the requirements established in the newly <br />adopted policy on encumbering wetlands. Mr. McDonald is dedicating the required drainage and <br />utility easements on three parcels that are less then 10 acres in size and dedicating a 66-foot <br />drainage and utility easement for the drainage ditch that generally runs in a north-south direction <br />located on Lot 4, Block I. Mr. McDonald and Mr. Makowsky have written the attached letter <br />stating that a drainage swale will be dug to direct the runoff to the drainage ditch that is protected <br />by the 66-foot wide drainage and utility easement that runs north-south on the subject property. <br /> <br />Recommendation: <br /> <br />City Staff and the Planning Commission recommend approval of the final plat of McDonald <br />Second Addition. <br /> <br />City Council Action: <br /> <br />Motion to adopt Resolution #02-02-. granting final plat approval to McDonald Second <br />Addition contingent upon compliance ~vi~h the City Staff Review Letter dated September 20, <br />2001, revised February, 8, 2002, and the developers entering into a development agreement with <br />the City. <br /> <br />Review Checklist: <br />Community Development Director <br />Principal Planner <br />City Engineer <br />CC: 02/12/02 <br /> <br />Copies To: <br />Parks & Utilities Supervisor <br /> <br />I <br /> <br />I <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br />I <br /> <br /> <br />
