NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />Access to Lots. There shall be a common access point onto Variolite Street N.W. for <br />Lots 2 and 3, Block 1, McDonald Second Addition. At such time that the Subject <br />Property is further subdivided beyond the four lots contained in the Plat, construction of <br />streets interior to the Subject Property will be required and the DEVELOPERS agree to <br />abandon the access onto. Variolite St. NW that 'will serve Lots 2 and 3, Block 1, <br />McDonald Second Addition. The driveway 'serving the aforementioned lots shall be <br />located in such a way to allow for the future subdivision of lots as generally shown in the' <br />resubdivision plan dated August 24, 2001 and prepared by John Oliver and Associates. <br /> <br />Drainage and Utility Easements. The standard 10 foot (5 feet on common property <br />lines) drainage and utility easements shall be dedicated along the perimeter of each of the <br />two tots. All areas where wetlands are located shall be dedicated as drainage and utility <br />easements on those lots that are less than 10 acres in size. In addition, on lots that are <br />greater than 10 acres in size, a 66-foot drainage and utility easement will protect the <br />drainage ditch that runs in a north-south direction. The DEVELOPERS also agree to <br />excavate a swale from the new lots to the drainage ditch located on Lot 4, Block 1. <br /> <br />Resubdivision Restrictions. The City adopted the 2001 comprehensive Plan on <br />December 18, 2001, which repealed the 4 in 40 density restriction on the Subject <br />Property. The Subject Property will be eligible for resubdivision to a density of 1 unit <br />per 2.5 acres,-in accordance with the 2001 Comprehensive Plan, following the repeal of <br />the "4 units in 40 acres" density restriction from Chapter 9 (Zoning and Subdivision) of <br />the Ramsey City Code. <br /> <br /> SECTION II <br /> PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in <br />the Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet <br />of the structure; (b) a Certificate of Survey, including that survey information required <br />by the CITY, has been supplied to the City Building Official upon his/her request; and <br />(c) all the financial guarantees required by the CITY have been satisfied. No occupancy <br />permit for any lot in the Plat shall be issued until: (a) all utilities are in place, operational <br />and accepted by the CITY; and (b) landscape tree, or escrow for same, has been <br />provided. <br /> <br />-271- <br /> <br /> <br />
