"Pedestrian Plan" means the portion of the Master <br />Development Plan, 'labeled "Trail and Sidewalks," that shows a cross-section <br />construction profile of the trails and sidewalks and the location of the trails and <br />sidewalks the Developer or Secondary Developers are or will be obligated to <br />construct on the Subject Property. <br /> <br />0m-)-Phase Public Improvements. "Phase Public Improvements" are those Public <br />Improvements the Secondary Development Agreement for an approved Phase <br />requires the Secondary Developer for that Phase to construct or install. <br /> <br />CmO-Phase. The City and the Developer contemplate that the Subject Property <br />will be developed in numerous phases, the precise boundaries of which are not yet <br />established. A "Phase" is a portion of the Subject Property intended for separate <br />Development. A Phase may either be a "proposed" Phase if the City has not yet <br />approved the Final Plans for that Phase or an "approved" Phase if the City has <br />approved the Final Plans for that Phase. <br /> <br />(--pp)-PreliminaD, Plat. "Preliminary Plat" means that preliminary plat for the <br />Subject Property as a whole which the City Council approved on August 12, 2003 <br />and any preliminary plat for a proposed Phase that Council subsequently <br />approves. <br /> <br />(-qq~Project Assessment Parcels. "Project Assessment Parcels" means the parcels <br />of real estate described on attached Exhibit I. <br /> <br />(~+Public Improvements. "Public Improvements" means those elements of <br />essential urban infrastructure, whether installed by the Developer, a Secondary <br />Developer or the City, over which the City ultimately accepts ownership and <br />maintenance responsibility pursuant to this Master Development Agreement or a <br />Secondary Development Agreement, including without limitation, the Developer <br />Public Improvements, the City Public Improvements, the Phase Public <br />Improvements and the Ramp. <br /> <br />~Public Ri~ohts-of-Way Layout Plan. "Public Rights-of-Way Layout Plan" <br />means Sheet __ of the Master Development Plan. The Public Rights-of-Way <br />Layout Plan is considered conceptual. Except for the layout of the rights-of-way <br />dedicated to the Public in the Master Final Plat, the final configuration of the <br />rights-of-way to be dedicated to the public is likely to differ from that depicted on <br />the Public R/ghts-of-Way Layout Plan.
